Do I have a claim?
Greetings, I have recently completed a promissory note process to discharge a line of credit for $50k. It went on for months however the lender placed a caveat on two properties and as I am selling one of them I needed to release the caveat so had to refinance the loan on the property to release the caveat. I explained to the lender who I supplied the PN to that that I was only refinancing as I was under extreme duress and being extorted by them. I advised it was an additional payment as the debt had already been discharged. I also told them that because I have now paid in RBA notes that they needed to return my original PN . They haven’t done this. I also advised the interloper (lawyer) who placed the caveat that they were extorting me and had unlawfully placed a caveat.
I have double paid them (one with RBA notes and once with my PN) and now I want my PN back and if they can’t give it back then they need to pay me in RBA notes to the value of the PN.
What are the thoughts on the best way to retrieve my property. now that I have also paiud in RBA notes they cannot claim anything from me yet they are still in possession of my note. While I dont agree that they didnt honour my payment and that the debt is truly discharged,…if they dont accept my PN then why wont they return it and how can I recover my property.
Can I target the man and woman responsible for holding the PN? What claims could I make? Theft, extortion? I am interested in the thoughts of the members. Thank you
