Module 21 - Court Application To Set Aside a Default Judgment -
First Court Appearance – Advice Please!
Hi! I’ll be making my first court appearance on April 1st. It will be at Brisbane Magistrate’s Court. I’ll be the defendant against the Department of Transport and Main Roads for a traffic camera infringement.
I’m not sure about 2 things:
1. Do I submit my affidavit before the first appearance (I have sent TMR the 3 notices of non consent and conditional acceptance. Included in the affidavit will be my All Rights Reserved driver licence and my birth source document)?
2. What do I plead? Guilty? Guilty with mitigating circumstances? Or do I not plead at all?
I’ll be doing as much study as I can between now and then.

From my minimal personal experience, we submitted the affidavit for court at least three days before court and also served a copy on the complainant at least three days before court with all of the relevant facts and exhibits to prove the facts. Hopefully some of the other members will give their opinion on this too, but you could ring the court and run it past them, they are sure to point you in the right direction.
