  • In Court Fighting QRO on Duty

    I’ve watched quite a few of Mark’s vids on Court play, and I’ve been impressed & surprised by the move to offer to pay 4X the money sought by the Government Agency on proof of Evidence from the Government Agency that they have responded to your Notices with Evidence on condition if they can’t provide the Evidence, they Pay 4X to my Trust out of Equity rules. I’m just wondering if there are any circumstances where this approach should not be used in favor of another angle? Reason I ask is I’m sure the Judge at QCAT will act to protect his QRO Commissioner by avoiding making a ruling that is injurious to this man. On the other hand, using equity to force the Govt Agency to withdraw the Notice to Pay because they have no evidence of response to my Notice sounds like it makes it easy on the Judge to side with me and avoid having to rule against his Commissioner…. Anyone got any experience with this?

    Mark is the man with extensive experience, a lot depends on who the judge is, how prepared you are for lots of different scenarios (learning and role playing what questions to ask, if and when the judge tries to entrap you or throw you under the bus) and how well you have prepared and completed your documents and processes before court.
