  • Needing help with Notice Process

    Hey team,

    In Dec 2021 I started doing the notice of conditional acceptance process due to the vaccine. Aus Post provided some hiccups on the way, however this is what I have done so far and am looking for help with what to do next:

    I have sent three Notices of Conditional Acceptance, one notice of demand and liability (invoicing), a bill of lading, notice of mail and or mailing and an invoice for communicating other than registered mail.

    Have I messed up the process? And if so, how do I remedy it?

    Did you get all three Notices with affidavit done within three months?

      No, because Aus Post put a delay on a lot of registered mail being sent

        But they have all been served? Once you have posted them it is considered delivered.

          What was the time frame within which you served all three notices with affidavit?

            Notice of conditional acceptance:

            1. 12th January 2022

            2. 23rd March 2022

            3. 17th May 2022

            Note: I sent two of each of these notices as Aus post had not delivered them when a reply was due.

            Notice of demand and liability (invoice)

            1. 10.03.2023

            I have been consulting with Zev from Warrior at Law with the process.

            Also if you have any information with how to handle SPER it would be appreciated

              It sounds like you competently completed your process. You never hear back from the adversary, but you have evidence now that you have an agreement with them. So the next move is up to you.

    There are examples in Module 9 of dealing with SPER.
