In the main he handled this well, he needs to ask more questions rather than making statements because under the rules of equity he needs a second witness. If he asks the constable “Are we in agreement I am a man?” Rather than making statements. Statements put the burden of proof on him, questions allow him to gain a second witness, as a man cannot be a witness in his own matter. He did ask some great questions having said that.

He handled that so well considering he had a bully boy threatening him and he was prepared with case law as well. The one thing he could have done was when they asked him if he was refusing he could have said ‘I am prepared to give you a breath sample when you can show me the blah blah blah” so then it would be a conditional acceptance and not a refusal.

It sounds like he was asking for the evidence that the act was proclaimed as law as an act is a law in the making. Most acts have never been passed as law. In Addition the former Chief Justice in 1942 was quoted referring to ‘pretend laws’, so this was happening back then, here is the quote, “a pretend law made in excess of power is not and never has been a law at all. Anybody in the country is entitled to disregard it”.

I applaud them for all for trying to stand up for themselves. But they ended up giving the name in the end. All the policy enforcers want is the name and even saying Paul Anthony from the house of Dickinson is still giving them the name. Im sorry to say it but that is all they want.
