  • QLD Infringement Notice Just Received – How Would You Deal With It?

    Hi! I just received an infringement notice from QLD Government in the mail (and have opened it… the envelope is in pretty bad shape).

    It is a carrying a mobile phone while driving offence, $1,209 fine. It wasn’t actually me driving, but I’m okay with dealing with it in my name.

    What is the best action to take to get this matter resolved? I have tried a couple of different approaches over the last couple of years, but never really had any success. Mainly because I wasn’t willing to take it to court. But I am this time if I need to.

    Fyi, my driver licence is signed “all rights reserved” and I have my birth source document.

    I’ve been giving it a lot of thought, and have decided to do the following:

    1. opt for the option to take the matter to court

    2. before the court date, send 3 notices of my non consent and offer to conditionally accept upon proof of valid claim. This will create an agreement that they have no claim.

    3. submit the evidence/affidavit of no claim along with my all rights reserved driver licence and birth source document

    I expect that if I do the 3 steps above the matter will be thrown out of court before the appearance date.

    Is this a good strategy? I’d like to know your feedback/suggestions.
