Remedy for a unrebutted lien
Posted by Danny on May 14, 2024 at 12:46 pmHi, Does anyone know any information on how I can submit a unrebutted lien to the legal courts?
I want to file my unrebutted lien to the courts in order to get a enforcement order/warrant from the courts, that way the courts bailiffs will pursue the debtor on my behalf.
I have found a application for a enforcement order/warrant on the courts website but it states the court judgement must be filled before I can apply for the enforcement order/warrant.
I am worried they wont accept my judgement and only accept a in court judgement.
I am not going after a corporation but yet a person who is acting as a role within a business.

Wow its funny you put this up, I just watched this video in hope of my answer but in the video it skips the part that would have answered my question. I have just sent him a email so hopefully he will get back to me.
I just found his channel and it has some great content so I look forward to seeing more.

Did you purchase his ebook? It’s fifteen UK pounds so not too expensive. Unfortunately it doesn’t say how you can go to court and has a default notice Affidavit sayign a default judgment is being sought but probably won’t have what you are looking for. I have some stuff from the CLC if you want to look at their stuff?

I havn’t tried this my self but i know a guy who uses this method successfully as a final step in his process
get your document signed by a NOTARY. a notary has the same standing as a magistrate.
if you find the notary resisting signing your original document, then another way to get it by , is to make a copy and have the notary sign that it is a true record of the original. .
then send it to the high court.(lodged)
like i said i haven’t tried it my self, but i know a guy who completes his process like this, he also, sends a copy to the local police, this is to keep the police abreast of what he’s doing and keeping them on his side,

A notary can see the living and the dead a jp can only see the dead..

Do I legally need a notary to witness my commercial lien? (Affidavit)? Or is a JP enough?

A Notary would be superior for a lien.

Thank you, I would have thought a JP would be ok as its it the public realm. I know the notary would be best but where I am in Queensland there is only one and he wants a lot for just one document.
