  • Signature on court election form

    Hi all, I have sent in a court election letter according to how the AussieSpeedingFines says. I sent the 1st Notice of Objection, then the Default Notice, Then the a letter of my court election, signed, along with their form of electing to be prosecuted, not signed. Apparently there is no legislation requiring their form to be signed. I have done this at least 10 times and it has always been put in the prosecution unit.

    Once my husband called and spoke to them about one of the court elections they rejected, and it was just because we put a PO Box and not our home address. The officer told him on the phone it is not necessary to sign their form because our letter was signed.

    Now back to the this current fine, they rejected the court election so I called them and spoke to 2 of their men. They both said they cannot process without signature on their form. I asked for their evidence of legislation that requires that and he told me to go get legal advice on that and contract law if I have any questions. We went round and round, him not answering my questions, of course. Then he hung up on me. It is in the fines unit at the moment, suspended. It is my son’s-in-law fine. Has anyone dealt with this specifically?
