Single Justice Procedure Notice
I need some help with this one if anyone can spare a moment please!
I got a speeding fine through the mail September 1st this year, so 3 months or so ago. I took a slightly different approach with dealing with it. I immediately sent the letter in it’s original envelope (albeit I had opened it) to the Births, Deaths and Marriages department with a hand written not inside saying..
‘This has been addressed to a Non Living entity (I wrote here my name ALL CAPS). Please forward to the federal treasury or relevant authority for settlement’.
I saw this approach on this forum from Mark in a discussion he had with someone and it resonated with me as the name addressed is indeed NOT me. It is the straw man version of me.
I was then apparently sent a reminder and a final reminder, which may have been the case as I didn’t open these, I just forwarded all the mail I received addressed to the all caps straw man version of me to the Births, Deaths and Marriages department with the same notes as in the first.
However, I have just receive a large heavier letter that I have in fact opened, maybe I should not have. This one has the court notice within. It says I have until January 11th to return a plea form. Either guilty or not guilty.
Also (which I find curious) within this envelope accompanying the notices and their evidence of sending the letters to my address, is a photocopy of the note with my handwriting that I sent to the Births, Deaths ad Marriages department. They also mentioned that on 3rd November the letters they had sent me were returned. The reason I find it curious is because according to their records enclosed, November 3rd is the same day they sent the final request for information. But that could be coincidence I suppose if the B,D & M department had just happened to send the letter all as one a day or so earlier, and the way it reads on the timeline of events is that the B, D, & marriages department sent everything back at once just a few weeks ago.
Either way.. what should I do now? any ideas?
Do I
A – send this letter in its original envelope (even though I have opened it) to the B, D & Marriages department?
B – Construct some form of affidavit and send that with a conditional acceptance directly back to the police department/address it to the Chief Constable?
C – Ask to appear in court and settle it there? Not preferred but willing to do it for more life experiences and practice.
D – wait for an official court summons of some sort?
All this bare in mind is addressed not to me but the all caps version of me. I never agreed or disagreed in writing to being the driver like they asked for, not did I agree or disagree in writing of any wrong doing, I simply sent the letters to the department responsible for setting up the Trust in my name at birth and asked them essentially to send to the owner of the Trust for settlement.
Any and all feedback is much appreciated!!

P.S – I do not have a licence signed All Rights Reserved, which I realise would be an enormous help here sadly!

Hi James you are best to start a three step Notice with affidavit to create an agreement be the court date. Once you have established a private default judgement and equitable estoppel agreement, it can be used to prove that there is no contract between you and therefore no cause to pursue anything from you. Module 19 has options to deal with infringements and it has examples of the three step notice you need to complete as well as an affidavit. Here’s some information about court

Tried purchasing the module you mentioned a few times now and it won’t process. I am trying learn quick here as I am not all the astute in writing affidavits and for me this situations seems pretty time sensitive. 10 days to reply to the plea. Do you have any info to get me going? I am not trying to duck out of paying for the modules, I am happy to pay regardless and have messaged the team with the problem.

Who would this be addressed to? The Chief countable by name, even though he/she is not named in the document anywhere, it just says ‘Chief Constable’, or less personal/specific to the Lincolnshire Police?
Should a successful three step process keep me out of court? or ultimately will I need to attend court to settle it do you think?
Finally, is the approach of sending mistaken identity mail (all caps name) to the Births, Deaths and Marriages department not a good idea then? Im guessing not! And In the affidavit/if I went to court is that something I should mention I did?

I just got a letter after sending my 3 letters saying I do not consent and asking for any victims that I have trespassed against present themselves, who has a contract that says I am your property, who has firsthand knowledge that I wasn’t conveyancing in my Private capacity and without a license on me at the time of this alleged incident. I have not open the letter, but wrote on the front Return to sender for cause without dishonour, Unclaimed, Do not accept offer to contract and No Consent = No Contract. I ask for a reply only with peoples names attached, Affidavits with responses to my questions and it must be by registered mail only.
Whatever you do, Be a Man before any name or title. Stay in the Private Realm and do not attach yourself to your fictional name. Avoid court, Offer to settle outside of court and give your terms and conditions with your Affidavit. Maybe a million dollars for any court appearance and all liabilities waived.
I will keep you posted, let us know how you go and keep strong in your position. There are only 2 Genders that rule over their Sovereign Bodies and that is a Man and a Woman. That is our land, our property, our Heaven and garden of eden. Thats why they are trying to corrupt it. Make us weak and doubt our full potential.

A nice message like that is very uplifting in these circumstances. It feels good to hear and read because it is true. I find it so easy to slip back in to a nervousness of judgement and outcomes based on the fictional version of me and make that ‘person/personification’ of me real, when it is not. My body, soul and my god given right them is the only thing that is real. I do have to keep reminding myself of that.
Good to hear from you and hope you get some knowledge and strength from your endeavour. I will check in for updates on how you are doing if you post anything. I will share here my experiences too. I am now just going to concentrate on an affidavit first.

There is no webinar but it does have step by step instructions of what to do in the module itself.
