Single Justice Procedure Notice
I need some help with this one if anyone can spare a moment please!
I got a speeding fine through the mail September 1st this year, so 3 months or so ago. I took a slightly different approach with dealing with it. I immediately sent the letter in it’s original envelope (albeit I had opened it) to the Births, Deaths and Marriages department with a hand written not inside saying..
‘This has been addressed to a Non Living entity (I wrote here my name ALL CAPS). Please forward to the federal treasury or relevant authority for settlement’.
I saw this approach on this forum from Mark in a discussion he had with someone and it resonated with me as the name addressed is indeed NOT me. It is the straw man version of me.
I was then apparently sent a reminder and a final reminder, which may have been the case as I didn’t open these, I just forwarded all the mail I received addressed to the all caps straw man version of me to the Births, Deaths and Marriages department with the same notes as in the first.
However, I have just receive a large heavier letter that I have in fact opened, maybe I should not have. This one has the court notice within. It says I have until January 11th to return a plea form. Either guilty or not guilty.
Also (which I find curious) within this envelope accompanying the notices and their evidence of sending the letters to my address, is a photocopy of the note with my handwriting that I sent to the Births, Deaths ad Marriages department. They also mentioned that on 3rd November the letters they had sent me were returned. The reason I find it curious is because according to their records enclosed, November 3rd is the same day they sent the final request for information. But that could be coincidence I suppose if the B,D & M department had just happened to send the letter all as one a day or so earlier, and the way it reads on the timeline of events is that the B, D, & marriages department sent everything back at once just a few weeks ago.
Either way.. what should I do now? any ideas?
Do I
A – send this letter in its original envelope (even though I have opened it) to the B, D & Marriages department?
B – Construct some form of affidavit and send that with a conditional acceptance directly back to the police department/address it to the Chief Constable?
C – Ask to appear in court and settle it there? Not preferred but willing to do it for more life experiences and practice.
D – wait for an official court summons of some sort?
All this bare in mind is addressed not to me but the all caps version of me. I never agreed or disagreed in writing to being the driver like they asked for, not did I agree or disagree in writing of any wrong doing, I simply sent the letters to the department responsible for setting up the Trust in my name at birth and asked them essentially to send to the owner of the Trust for settlement.
