    Hi guys

    Context:
    – BOE sent to SPER –
    – Completed Meeting
    – Doing 3 step process equitable estoppel, Notice and Demand, Notice and Default….
    – Still need to send “First Notice of Default Judgement”, and “Final Notice of Default Judgement”.

    I have today Received a text from SPER saying my license is suspended, which I expected. I also received a call. I did not answer either of these as I have expressed in my notices they can only respond to my PO Box. so I will say their responses are invalid in my “First Notice of Default Judgement.

    I obviously have to travel for work, but I drive to each client as I am an independent private HCP carer and my clients do depend on me more so because I work privately working for them directly.
    I am wondering how others have managed being pulled over? or what module and material have helped you most with this? I will need to create a script just incase, and rehearse.
    The module 19 doesn’t have a webinar so I am wondering if this is the best one for me in this case.
    or module 18 maybe?

    I have noticed on the Driving and Travelling forum, a lot of people seem to need to go to court for the suspension to be lifted. I still have 2 documents to put through and a final invoice. If anyone has suggestions on what I could do about the license while I finish the estoppel, that would be great.

    I am definitely not folding on this, and I am finally confident I have mostly done well with this process, but I do want to avoid court if I can.

    any material or info on where I should direct my study or focus would be great

    Hi Mark says it well in one of the videos which is “free to members” If I remember correctly.

    YOU MUST HOLD YOUR POSITION … SAY THE FOLLOWING TO THE COPPER

    cop says :- I need to see your ID

    Am I under arrest?

    cop says :- I need to see your ID

    Why have I done something wrong ?

    cop says … blah blah blah

    I am happy to do business with you officer but first I need to see –

    1) your business card

    2) the name of your “Indemnity Insurer”

    3) Your Indemnity Insurance number

    YOU MUST HOLD YOUR POSITION

    don’t forget to ask the copper 3 times … if he refuses to answer then he’s in default (Mark says that… 3 times comes from the “Bills Of Exchange Act 1909 (check Sect 5) is the principle act which governs commerce” … video in question is (Rules of the Game – Melbourne 2023 Workshop (cops-court), video 2 “Communication” at 4m50s)

    As for the court part I cant help you there suffice to sat that reading the brief about each video & then listening to the video is the only way to find what your looking for, or in a Q&A & ask Mark about which videos you need.

    Im only new , still learning (from the videos), There are others on here with heaps more experience than me that can clarify better.

      Hi Glengs, Yes, I actually tried to purchase the module 18, but the SE system is showing a 404 error at the moment so I cant purchase anything. I have tried throughout the day with no sucess. Bad timing on a weekend to have a technical error.

      Yes I really need to watch the courses, thank you for this 🙂

      I was going to ask if anyone knows.
      I also received an email today from SPER as well. However, I haven’t been responding to the emails at all except in my estoppels, just to explain I received the email but it is not considered a valid response.
      Should I continue just referencing them in my estoppel, and not reply to an email?

        I can’t even watch the webinars at the moment so I’m flying blind for now.

          Have you contacted the team about your issues and told them which module you wish to purchase?

            it was fixed by Monday, they didn’t reply, but I’m assuming they just fixed it

    Hi, this is very interesting. When I received a sper debt of over $11,000, I nearly had a heart attack. This was back in 2019. When I called them, back then they would actually put you through a person who was looking after you debt and they would listen to what you had to say. Back then I quoted section 56 + of the Commonwealth of Australian Constitution Act 1900. And stated you cannot under the constitution charge me excess fees. He new what I was talking about and said I will get back to you in a couple of days. He did and the amount had be taken back to $140. How crazy is that. Now my cousin has just received a bill of $12,000. We called sper and they refuse to allow him to quote the constitution and the first customer service officer abruptly ended the call. So we called again and this time we managed to get the call reference numbers which they were hesitant to give. So we started to quote the constitution again and she was like, no, no, no you cannot say that you have to pay your bill and hung up. It was crazy. We have recorded the conversations and now I am sending them a conditional acceptance to provide evidence they can add excess fees on to the fines and that the Commonwealth of Australian Constitution Act 1901 does not apply to them. His licence was suspended but he had to drive to get to a job out of Brisbane and he received a weird note, not a ticket, and had to appear in court for driving unlicensed. I suggested he keep adjoining this until it goes away and have time to get this sorted. I am only going to give them 7 business days to respond. I will let you know how we go. When we get the fees removed and we will then we will make them an offer to pay 10% off the remainder of the fines. How is your process going?

      Hi Lee, I have an issue with SPER too for $1400. I sent them a letter to answer questions at law and also I sent them a fee schedule if they fail to answer to my questions. I applied that and I’m yet to hear back from them. Apparently the fee schedule works having heard this through someone who had tried it saying it worked. I have heard if you hand it to a police officer, they have been known to be quite concerned.

        Oh ok I have never heard that one. I am currently doing a Conditional acceptance for a guy who has a $12,000 debt. They have just responded with a load of acts that do not apply to men and women. So I will continue with my notices and then affidavit until they remove the fees then we will make them an other. He also had his licence suspended and that was done before I started to help him so I and suggested he keep adjoining it until we get a result from this. I keep Sper up to date on what we are doing and that the amount is under dispute. But as far as the schedule of fees goes I know we send it with our notices and whether it has that type of affect I am not really sure sorry.
