    Trust problem – QLD Stamp Duty exemption s118

    Hi all, I had an application for stamp duty exemption for my non+registered trust that I purchased through SE, it was rejected.

    They said it was a “creation of a new trust” s53 of Duties Act and therefore I had to pay stamp duty

    It looks like they might be right as s53 states that stamp duty occurs when “a trust is created when a person acquires a property who is not originally a trustee”.

    Any thoughts on how to appeal this decision?
