V-Cat hearing
Hi All , just need any advice , I have a property in which my next door neighbor caused considerable damage when building his property . We went to court for 3 yrs and we received compensation.
He agreed for us to demolish my property and rebuild the council approved also. However he now has taken me to v-cat because he does not want our front wall taken dwn as it is Heritage listed , but the heritage council has given us permission to also demolish the wall.
My question is can any body please advise as to how we can stop going to court and costing us even more heart ache and problems he has already caused . The neighbor is very wealthy but we are not and this will cause major problems ie bankrupt .
The council is on our side . I dont believe that he has the right to stop us from going ahead as he has no legal right to any ownership or anything else in my property .

Hi Deretto you need to start a three step non consent conditional acceptance process with affidavit in the private.
