    After a year of trying to fight SPER , I have to submit, I am finding no solution or remedy in the content provided or that has been shared on this forum.I like the information, it is informative, however, I have not seen anyone have a win against SPER in the year I have been a member, nor against the tax department in the discussions. So I am canceling my membership. Good luck to those trying to fight the corrupt corporate system here. I wish you well and a Merry Christmas.If I have missed the wins, feel free to send me a message and I may reconsider my position.

    Thanks Joe, for posting this. Although I am in a different country than yourself, I find this post helpful. If you haven’t left already, would you give us a short description of the steps you took?

    Hey Joe,

    Have you been learning and looking for a solution at the same time while your under pressure caught up in the system ?

    a big part of this kind of education is so you don’t get caught up in the system again. pick your battles , some things you just have to suck up and pay , then one by one remove the systems tentacles from your life. it all takes time .

    SPER is the Qld State Penalties Enforcement Registry I think.

    Mark has some webinars on wins.

    Have you watched them?

    In the past I have paid SPER fines because that was the line of least resistance at the time.

    Just recently though, I had a fine discharged. I signed my license the way Mark recommends (By: my signature All Rights Reserved), and did the same thing with the copper and the court election notice. I received an email last month from the senior legal officer from the department of transport and main roads saying that they waived the fine. I was fully prepared to go to court though.

    I’m currently working on a tax issue too

    So Mark’s stuff works but probably mindset is the most important thing. Mark never gave up when he had some setbacks. Just got to keep going.

    Most people have setbacks or failures now and then. The key is to learn from them and do better next time

    Being prepared is good too 🙂

    Hi Joe,

    Sorry to hear that you have not been able to resolve your issues with SPER.

    I have been meaning to report back about my experience with Revenue NSW and I think this thread is probably an appropriate place to do it.

    I originally received some dubious “driving with unrestrained passenger” and “driving while using mobile phone” fines. I was simply writing declined in red on the statements of account and sending them back. This worked for a while until they suspended my license. I elected to go on a good behavior license to buy me some time and also elected to go to court.

    I then began the 3 notices process. I have just sent in my declaration after they defaulted on my 3rd notice. Between my 3rd and final notice and sending in my declaration, Revenue NSW advised me that Transport NSW has requested that all pending fines be removed. I now have a clean license (no demerits) and I have protected my vehicle and license from further claims (I do not have an all rights reserved license).

    Revenue NSW made the mistake of sending me a not voting fine on behalf of the NSW electoral commission (I am also in the process of noticing them). Because Revenue NSW have agreed to never pursue another claim against me I have now invoiced them for $3500 with a notice and demand for payment attached. They may not pay me but I’m sure they will think twice before they send me another notice. I will keep going with 2 more notices and demands for payment just to see how far I can take it.

    So I have had some success with this process, time will tell how successful but I certainly feel like I have had a win and am at least standing up for my rights and not letting them defraud me or get me down.

    I’m also in the process of dealing with Linkt/Transurban to protect my vehicles from illegal toll notices (invoiced them for $3500 too) and I am one notice off discharging my credit card with the A4V money order process. I’ve had some very interesting interactions with the bank (phone and Email) and as long as you hold your position they either go silent or send someone else to say the same thing to you, all clearly because they have no other option than to try and avoid their obligations or try to trick you into thinking these processed do not work.

    I hope my experiences so far give you some motivation to keep at this path, it is certainly not an easy one but I feel it is the best way of slowly unplugging from this corrupt, rotten, fraudulent scam we all live under at the moment and standing in our own sovereignty and power.

      Hi Berniew, great to hear you had success with the A4V with your credit card…….go you! Can you please provide a little more detail on how you achieved that? I have started the Bill of Exchange process with that with my partners credit card and also our Gas. The Gas complaints department phoned me to find out what my “complaint” was and after a brief conversation where all I did was ask him further questions I asked if there was someone else I could speak to who might know the process. He said that he would forward my documents to their legal department which I took as a small win because he did not deny any of my assertions. That was about 3 weeks ago, still waiting to hear back from them. I would so appreciate some more details of your successful process. Thanks Ann-Marie

        Hi Anne-Marie,

        I’m actually still going with the process so I wouldn’t say I’ve been completely successful yet.

        With the credit card I’ve now sent 3 notices asking them to provide evidence that my payment was not compliant with the BOE act. They failed to reply so I sent the declaration and made a 4 fold counter claim and have now sent off 3 demand notices for payment of debt. Had quite a few exchanges with the complaints department where they just repeatedly claim that they don’t accept hand written money orders as payment which I have always replied to by way of a thanks for your confession you received payment and further questions.

        I’m now at the stage of sending a second declaration and not sure exactly which debt recovery process to use. I’m thinking an application to credit rating company (cant remember their name) or a statutory demand for payment of debt. Might need some more advice on that one because I haven’t done this yet. It will be very interesting to see if I can get any $$$ out of them.

        At this stage I consider the credit card discharged but I haven’t completed the counter claim process. They have still been sending intermittent arrears notices which means they haven’t conceded quite yet. I’ll keep at it and let you know if I have any success. Keep up the good work!

    HI Joe, sorry to hear about your experience. I must say that we have had success with the ATO in claiming back part of our Tax using the tax amendment form. Three of us in our family got back tax using the productivity of labour line, as well as a friend of mine. We have a few court cases on the go at present challenging fines and we have had 1 court win (using non consent process), and are appealing 3 others which I do believe we will win eventually. The key is to review the material over and over again, and I must admit you do need resilience and determination to keep up the fight.     nomally you need good standig in that process because the state penalties enforcement registry wants to steal your money although they have the obligation to settle your account. It,s not correct that they try to oblige the people to pay with liquidity (AUD) , because you can,t settle a asccount with liquidity. These are the rules of the International Monetary Fund (imf.org). You have to make clear that you are the beneficiary of the trust not the trustee.

    I,m not located in the commonwealth of australia, but i following this issue for some time (Bills of exchange) and so on. Check out this screenshot but this guy made it without stamps (1 AUD and 10 Cents), and it seem to work. As far as i remember Mark said it,s good to make it with stamps. This has maybe something to do that it,s good to be the postmaster but i,m not really sure.

      I’ve seen that remittance process before, though am unsure where to send it afterwards. Some say to the Federal Reserve, some say to the CEO of the relevant company or to the CFO. I have attempted this process as I’ve been unsure who to send it to, to discharge the liability.

      Any help would be appreciated (:

        they are the administator of the trust and you are the beneficial of your cestui que vi trust (your birth certificate). So they are in charge to settle the account, if you send a remittance they have to dissent in 72 hours. If not the contract between the two parties is agreed. They won,t send you feedback, because they do not want to educate the public. Same procedure in court (adjournment sine die). To hold your position is essential if they do not know the rules that,s not your problem.

    I know this post is from a while ago but thought I would add my 2 cents worth. Fighting with council for unpaid dog and cat rego for 2 years. Ling story short they took me to court and I lost. Judge completely ignored everything and fined me 2k. So I sent a BOE to Fines Vic. I received 2 letters saying they hadn’t received payment so I sent a copy of the accepted registered mail that contained the BOE and said as far as I am concerned the matter is closed. They sent 2 further letters which I returned to them as the envelope contained only a PO Bix so I sent back as unrecognized. Now I don’t want to count my chickens before they’re hatched but is now been 5 months old nd I have not heard anymore. Have been told they will try again at some point but I am ready to hold my position. With regard to this matter I complained to the Judicial Commision about the judge ignoring evidence and was told to bludge a Writ of Mandamus through the Supreme Court which will force their hand and make them abide by the law.. not a legal process. I am struggling to find info on how to perform this WoM process. Can anyone assist pls? 🙏🙏
