Infringement notice HELP NEEDED
Posted by mick on May 11, 2024 at 6:06 pmI’m trying to figure out how to proceed, or where to start I am confused with all the module info, it’s not clear what I should write back to the issuer. Do I write on the notice, if so what do I write, and do I send my own letter with it say non consent and the advised questions? If anyone has done an infringement notice to service NSW I’d love some advice as to what to do.

There is a module to deal with infringements. But expect pushback with whatever you do. There isn’t a silver bullet. Just need to listen to other modules too.

Here is a copy of a letter I wrote to the Queensland Transport and Main Roads. This was for my wife which she received in a work car… after she had finished working for that firm infact. She’s a very careful driver normally… it’s usually men that gets the infringments!
I used Mark’s process as you can see my appraoch here. I’ve attached it for you. You may use it for reference if you like. Please keep in mind I have only just done this and I have not yet received a respone from TMR. I don’t know if my appraoch will work.
I took their ‘offer doucment’ being the infringment Notice… and wrote all over it. with details of all the claims they had made and the lack of proof they had actually provided. I then turned that into an simply contract and attahed a letter.. then a affidavit of facts for my wife (which she had signed at the JP) and another blank affidavit for them.
Let me know if this was helpful. I also gave them a schedule of fees.
Us this with caution, I have not tested it yet.

If you have written your first notice then a default notice just repeats the questions in that first notice. Is that the sort of default notice you are looking for or are you asking for something else?

Hey Morag,
It is a matter of starting the process and as you get pushback then do more research to reply to the pushback. Very very rare you can get anything over the line with a single notice from my experience.

Wrote and Sent the first notice today. Re rote Marks notice to the commonwealth bank for the old couple. Spent two hours on it. Then sent it with there latest statement and addressed to the CFO and CC the customer relations that emailed me. Really made the letter mine.

That’s great, so for the default notice you just repeat the questions and the agreement that will be reached if they fail refuse or neglect to answer by the specified date and time.

I didn’t much around I gave them 72 hours. I made a request for call back for lack of reply the didn’t call back so first notice out. I could of easily thrown in the towel as it’s going up a $100 a month but I’m holding my ground because they kept the BOE

This is no guarantee that the matter is settled and closed, but for now, I have been sending their letters back RTS, unopened since October with the privately owned Where’s Wally boxes sending out fines straight from the Department of Finance (?) – not police or transport. I have a few sheets of adhesive labels (attached) ready to place on any corporate Govco fine, or offer to contract. I also write in red ‘Unclaimed’ on the back, and ‘Incorrect Postal Mechanics’ under their RTS address because they haven’t identified who the sender is, it’s internal mail they send to themselves and we shouldn’t be opening a windowed envelope. They just want us to believe it’s meant for us with the visible ALL CAPS name. They reply with another letter and I RTS again. After 3 times, I have received a few texts allegedly from SPER but I reply by text and tell them I’ve blocked it as spam. The card is still in my purse for now and the bank has been noticed that any deduction without my expressed consent by any party such as SPER, ATO, etc will be assumed to be theft without our knowledge or consent, but I keep a minimum balance just in case.
Below find the final text (with limited characters), I sent following a texted Notice for further and better particulars and a Notice of default –
Private Judgement
We thank you for your offer to contract but We do not understand. We do not do business over the phone. As SPER has failed, neglected or refused to provide the wet ink signature contract between ourselves and SPER, a third party interloper, signed by both SPER and ourselves, stipulating where We ordered goods and services from SPER, and failed, refused or neglected to provide the evidentiary documentation of a guilty verdict against the living woman, :lyn: no fines or penalties can be imposed without a guilty verdict delivered by those with judicial authority. SPER’s failure, neglect or refusal to do so affirmed SPER’s tacit agreement that no such contract exists and the matter is thereby settled and closed. Our bank manager is notified that if any funds are withdrawn, purloined, stolen or transferred to any entity without Our express consent it will be treated as theft of Our private property. As the State owns the driver license and any title to our automobiles, is the State not the Trustee? We are the Beneficiary. Any further contact will be charged according to the following fee schedule as stipulated below. In the absence of an individual, the head of SPER will be invoiced and held liable in their private capacity. Further attempts to contact us without providing the evidence as stipulated is evidence of attempts to force or compel performance through malice, is harassment and may be reported.

1. Per text: 100 Australian dollars
2. Phone call or message: 2000
Australian dollars
3. Letter /page: 1000
Australian dollars
4. Breach of privacy, sharing private data: 1 million
Australian dollars per incident
5. Per court attendance: 1 million Australian dollars/day
6.Negative impact or feedback in credit rating: 1 million
Australian dollars
7. Incidental time wasting, research, or other tasks:
1000 Australian dollars/hour
8. Loss of points- $1,000/point
