Question Answered During This Q&A Webinar

00:02:20 vic: i Mark, Sorry for the length of this question/s:
I have a complex tax structure involving a Family Trust, Partnership (both with separate TFN and ABN), and individual returns for my wife, daughter, and self, outstanding for 24 and 25. The Partnership and Trust historically use separate complex forms, with outcomes distributed to personal returns. Your module seems to use one form for all, which I feel won’t meet my complex needs.
Alternatively, I propose to have my accountant complete the usual complex “Partnership” and “Trust” forms and submit them so that I am reporting everything properly for these 2 statutory entities. I will then do the individual returns as per your module, incorporating income from the Partnership and Trust with personal expenses then resolving any taxable income received (personal, Partnership or Trust). Have you any further guidance, or suggestions contrary to this proposed approach?
I propose to close down the trust after the 2025 return, as there will be no further trading.

00:02:29 Daisy Doone: Question….. If someone in a council returns your affidavit that you sent to the council, and it was signed for via registered post, and they say they do not accept affidavits! How would you respond to this? Resend it to the council reminding them that an unrebutted affidavit stands as truth in commerce? What else should one do when the council returns your affidavit unrebutted?

00:03:03 Jayne: Q: Are your trusts you set up revocable or irrevocable and why do you choose one over the other?

00:03:31 vic: Q Part 2. The Partnership however was created for property development and must maintain GST registration until 2009, or the disposal of all properties. I’m currently selling the properties to expedite Partnership closure and GST cancellation, but each sale incurs 1/11 GST on the sale price (4 in total). Since the properties have been completed since 2014 and managed as investments, I’m unsure of ways to offset this GST burden, assuming it needs to be paid post sales. Do you have any strategies beyond what’s covered in the module that could help?
Lastly, I’m more than happy to pay for consultancy time, but encountered a 404 error when trying to book through the website.

00:04:46 Moya Kelley (PAWS): Do you have an example of the correct way to complete the council rates with BOE Ie turning rate notice into a BOE

00:05:18 Jayne: Q: Have you ever set up trusts in a layered structure, eg Have the beneficiary of the first trust as being another trust know as the “living trust” and then the ultimate beneficiaries are the beneficiaries in the living trust. Hope that makes sense

00:05:23 Moya Kelley (PAWS): is the council by law bound to accept a BOE Even if it is not listed on a rate notice as a form of payment

00:06:07 PeteRRDJ 269: Q if you had a lazy $5000 to begin investing would you still recommend bitcoin or would it be better off in a gold account in your opinion ?

Question. would it be wise to send the final notice to a company stating “if they cannot answer the questions and continue to make threats with menace litigation proceedings will commence”? I’m tossing up if I should go down this path, I’d like to avoid going to court to settle a matter related to BOEs delivered and accepted but their account ledger is continuing to state account is over due and pay now nonsense ? i have sent and they have received a fee schedule summary also for failure to provide proof of claim.

00:07:48 Bill Thomas: Q: Are taxation & audits voluntary in the U.S. also?

00:08:03 cath: Question – We are in the process of buying a house, Our conveyancer is saying that the bank loan documents need to state that the bank loan documents also have to reflect that you are borrowing in your capacity as a trustee, is this true in Victoria? Or are we better off having her dealing with the state revenue office or do we go to the titles office after settlement date to change this ourselves?

00:08:32 Bill Thomas: Q: When paying a credit card off with a 10% payment in full and final satisfaction of the debt, what proof wpuld i send to Equifax that it’s paid, so they do not list me as delinquent?

00:09:50 ka: QUESTION – when dealing with council and sending invoices as per my fee schedule, who do I actually send them to? I understand we as private men/women cannot mix and do business with corporations, so I’m trying to be the “living woman” but I should be billing the council? Or do I send the invoiced ONLY to the CEO in his private capacity (even tho I’m using his surname all the time), which I’ve just argued with them is a work of fiction yet I’m trying to use it against him. who do I send a statement to, the individual or the council? And when I’m expecting them to contract with me over that, does that pull me back into contracting with them… not sure what to do with the invoices, and who I’m expecting to pay it (I wish, I KNOW none of them will pay it LOL)

00:10:12 cath: Question – We know an accountant that checked on their system, and it turns out that I have been flagged by the ATO. I completed a personal tax return as per the module, should I be worried? I didn’t claim all the tax, I only claimed half

00:10:24 russ: consrciptions,if this fake PM pushes for war how is it best to deal with conscriptions, I know they ended in 1972 but these idiots do as they please

00:13:12 Bill Thomas: Q: If I send a 10% payment for full & final satisfaction of a credit card, am I able to use the card while waiting for them to discharge the liability, while I hold my position?

00:16:58 dail bird: Q: ive just completed turning a statement of account into a contract, I numbered the blank zedded out back page, would that have any effect on as far as voiding the contract.

00:17:21 Juan: Q. Is another argument against paying rates the Qld Rail vs Union case, where essentially
if you are a government department and have an ABN, then you are treated as a
corporation and hence need a contract?

00:17:40 Juan: Q. My apologies, a few questions on BoE
(1) To confirm my understanding, a $1.10 stamp on the contract we have amended and
accepted, means that the sum certain of a BoE or money order or cheque would also
be $1.10 to discharge the debt?

(2) If I used a $1.10 stamp but wrote the Boe for one AUD, is there a problem?

00:18:09 Juan: Q. What is the process for creating common law copy right.

00:19:31 Bill Thomas: Q: In the U.S., can I quote the Australian legislation on my PN, or should I leave it off until I find the American equivalent?

00:20:04 Juan: Q: If the affidavit you did for tax mininmisation, you wrote the following “I, anwsering to the John Henry Doe
of suburb x, Victoria, in my correct public capacity as the beneficiary to the Original jurisdiction

…..” Q 1: if you substiuted John Henry Doe for just John-henry, being the proper name, does this statement
still read true?

Q2: what is original jurisdiction?

Q3: If I add to the affidavit that the following statements

(1) “When used in the commerce, the name John Henry Doe, is done under duress
as I have found commerce requires a last name to do business and to be clear, it is not my ‘proper’ name.”

(2) All credits taken have been under duress and threats of inability for one procure a job.
Will these additional statemens negativily affect the affidavit?

00:20:24 Juan: Q: I do not understand how I have the authority to act in the office of executor and beneficiary of the all caps name as I cannot point to any fact to do so?

00:22:28 Bill Thomas: Q: In the U.S., do I also need to go to a public place like a coffee shop with my notary to present the PN for payment?

00:23:13 Leanne Whitehouse: I have been requested to be Truistee for a Public Trust that will become effective when the parents of an Autist offsping pass it will be activated by their will.

The parents would like to have the offspring to live in the property for the rest of his life.
I asked what the weekly mortgage is and I was informed $600 per week.

I let them know that as Trustee of the Trust I will have to raise a loan to pay out the mortgage.

My next question was Would they be open to finding tenants for the other rooms rooms to provide the trustee the ability to pay the mortgage? The answer was yes

I then asked who is the guardian of the offspring. They where unaware of the implications of not having a guardian so they are looking into that.

I would love to turn this propertuy into a Supported Independent Living property for the offspring and two other participants.

During the will activation with the property being passed onto the Public Trust. Will Stamp Duty be applicable for the Trust

00:24:20 Kevin: Hi Mark.
Q…How could I deal with Centrelink if they found out about a payment I received (a tax refund due to the productivity of my labour) but I didn’t report it to them with them claiming it should have been declared as income/payments received and them threatening to reduce my fortnightly payments?

00:28:01 pjaish: sell all as a going concern. I bought a small block and did it that way and paid no GST that way

00:28:24 ka: QUESTION – how often do/would the council write off unpaid rates as a bad debt on the books, or do they not so they can keep chasing it? Once it is written off the books as a bad debt, they can’t then chase it as a current debt is that correct???

00:31:39 Bill Thomas: Q: Since a payment refused discharges a liability, why is it If when we send a ten percent payoff to a creditor &:they return the check to us, it’s not discharged? Is it just easier to send a 15% payoff check next, and be done with it?

00:36:10 dail bird: Q: Are councils (being a corporation) a company as I’m sure ive seen possibly in the corporations act that all corporations are indeed companies.

00:48:17 dail bird: Q; Does the default payment of the default and Liabilty clause, within the contract, get invoiced every time the parasites make a new claim, effectively $10,00.00 then another $10,000.00 and so on.

00:51:15 Bill Thomas: Q: are the IRA’s that say they will buy physical gold or silver they hold for you a legitimate investment, or are they a scam like the paper certificates you can buy that are supposed to have silver that you can claim (but doesn’t actually exist)?

01:10:38 Leanne Whitehouse: Q. I have been asked to be Trustee of a Public Trust when the parents of an autistic offspring.
When the will kicks in, can I as Trustee fold the Trust and open an unregistered trust.
Will Stamp duty be applicable if Trustee of the Trust has to pay out the loan in the e vent that this occurs

01:11:49 dail bird: Have a laugh. Council jumped the locked gate with a trespass sign to shut off a ladies water. The lady rang the local pirates to be told by 2 dickless tracy sargents that trespass is not a criminal offence and this has nothing to do with pirates as it is a council matter. Now the qld ethical affairs are looking into the dickless tracies conduct and looking at the councils trespass.
