Hi, yes I did my tax return using Mark’s method and it triggered an audit. The ATO claimed that I did not take reasonable care in preparing the return and that I was reckless, and fined me $7289. They even noted that I was not being dishonest. Interesting! I am in the process of writing a reply, holding my position.

Hi All,
Re fines, I’ve heard that only courts could lawfully issue fines.
Is that true?
If yes, does anyone know where that comes from? (A court judgment perhaps?)

My current dilemma is that after I received the ATO audit letter saying that I was reckless, I think I sent 3 estoppel letters. This was 3 years ago. Trouble is I don’t remember, I don’t have proof that I sent them. Although the fact that they haven’t chased me for 3 years may be a good indicator that I did. This is for my 2019 return
Anyways, I’m unsure how to proceed. I didn’t know how at the time
Should I start with a new 3 step process, hopefully they’ll default, then take it to court? I don’t feel competent doing court by myself.

This return is the first one where I’m claiming a lot. Every other one I’ve been squeaky clean. Now I want to make up for that, and as Mark says, have some fun with them. 🙂
The ATO in their letter said that that it was an audit just for this return
