    From what I heard Mark say the by is because you are living and therefore you are the “by”.

    The reserve your right part is because you reserve your rights within the agreement/contract.

    Could be more to it but that is my understanding of it.

    Hi Morag,

    I have watched the first link but I don’t believe the second one.

    I have only lodged my complaint to the local station so tonight i plan to lodge it to the the main headquarters and the Crime and Corruption Commission. Thank you for your reply.

    I went into the court house today to ask so questions about being legally served and they said the UCPR do not apply when it comes to the police issuing you a summons.

    Not sure if this is true or not but im not going to dispute the serving as i have now the document that gave rise to thr birth certificate, so ill just be taking that to court.

    I can not believe they are still coming at me, such crazy this world.

    A lot more to the story as I had sent lots of notices before but i also sent the notices during the mediation also.

    Once I had them in check I went and lodged my complaint.

      I must add I had the bailiff come to my house twice, once when I was there and I was able to state that is not me because it is in all caps and a corporation and that I can not help them. ( they did not what to do and just left)

      The second time I was not home by my girlfriend was, I told her to say she knows nothing about the situation and does not consent to taking the document on my behalf.

      Because the summons was out of the blue (meaning the last time I had heard from the party was some 4 months prior) I then new I had either deal with it in court or as for a round table meeting.

      Once I setup the mediation ( which when I asked to do face to face they said no and would only do via phone or email) I then setup a ton of setup questions and had them in a private default judgement again. That is when I lodged the complaint and so far so good. Fingers crossed.

      This is for a debt collector and to the valve of $20,000

    Hi Brandon,

    What I did is ask for a mediation with the party lodging the statement of claim, that way it stays out of the courts.

    I then sent them demand notices, it was not easy as they just kept coming but in the end I lodged a complaint with the Australian financial complaints authority.

    The party has stopped all contact once I lodged the complaint.

    The afca are still viewing it all but the party never corresponded to the afca as advised by the afca.

    Thank you, I would have thought a JP would be ok as its it the public realm. I know the notary would be best but where I am in Queensland there is only one and he wants a lot for just one document.

    Wow its funny you put this up, I just watched this video in hope of my answer but in the video it skips the part that would have answered my question. I have just sent him a email so hopefully he will get back to me.

    I would target the cop straight away, I would email him a notice of demand and particulars. I would add a fee schedule too. I would maybe see a lawyer as they can go after him, but maybe do your notices first so you have that fee schedule in place.

    It is great you have it recorded, I would send away the complaints straight away.

    I would honestly see a lawyer as it does sound like you can claim damages. I can send you some complaints I have done if you? You can take what info you like and discard the rest.

    Here are come laws and acts they have violated they have broken too.

    On the fee schedule there is a act they they violated so I add this on too, plus it gives you a good reference to use if you want to do up a invoice.

    To me they are in the wrong and you have evidence of this, so to me you can do up your own claim of damages via a Notice Of Payment of Debt with a supporting invoice stating what damages you want to claim, you can put the acts and Laws they have broken in the invoice .

    Or you can take your evidence to a lawyer and get them to do it all while you are doing up the complaints.

    Hey hey,

    Did you happen o record it or have a witness with you?

    My first point of attack would be to get the footage from the Rights to information portal, (you have to summit for this) make sure you demand the body footage as they will try only give you the dash cam footage.

    Or you can request this in the court proceedings.

    I would be seeking a lawyer to be honest as it sounds like you have been unlawfully and legally arrested, plus many other things.

    To see a lawyer would be the quickest way to get them I’m my opinion.

    I would while you’re building your case with the lawyer be lodging formal complaints to everyone. (I will send you a list of the ranking to whom you can complain too)

    I will message you and send you some good information too.

    With the driving license being canceled I would drive away, I mean you know you’re in the right so fuk them.

    If they pull you over just stick to the script but be better prepared.

    My advice is next time is to just surrender and state you comply under duress but don’t consent.

    Then take the fine and take it to court.

    While you’re waiting for the court date you can get the RTI and formal complaints under way and set them up using the 3 step demand notice, put in a fee schedule too and that way when they default you can then start the demand for payment notices.

    You can send them Demand notices for further and better particulars but it sounds like you have enough to go after them now anyway.

    I don’t know if you could send them the 3 demand for payment notices and do up an invoice.

    I’m not sure if a fee schedule has to be issued first or not.

    To me you can list the damages they have done and send it but this I’m not 100% on.

    Maybe someone else could comment on that.

    Yeah for sure, It is annoying to know you are right but still have to play their game.

    I wanted to ask these questions to see if you may help? If not I will ask Mark next month.

    Q. I sent a A4V to discharge a liability but I did not send and fee schedule or a default and liability clause with my A4V. The party is in a commercial default so could I still send out a notice for debt recovery to the fiduciary?

    Q. I want target a CFO that received my A4V but did accept it, but they no longer work at that business, who can I hold liable for the commercial default that was achieved? I did sent it also (the A4V) to the accounts department manager but I did not address it to anyone in particular.

    In my first notice there was a fee schedule and I mentioned that fee schedule in the default and final notice.

    So i believe I am good to go lol

  • To me it is all connected so I enjoy learning it all, the legal side of things go hand and hand with the all cap name.

    How does one go about becoming Grantor to my Name held in Trust?

    Also you say anyone can do it?

    You mean I can lodge a conditional acceptance form to the courts if they don’t issue one of the website? I know that have a conditional acceptance form for civil but not criminal.

    I have tried to call the courts but they don’t call back, they telling me the register will but he never does.

  • I know what you mean, I have been just repeating in my mind it is a mind game and my fear is their power. Some days are good and others are no so good but I just know I don’t like being a slave or being deceived.

    Also the the other thing I say to myself is be comfortable being uncomfortable.

    yes I have been studying like crazy, over the last 3 years I have been writing notes like you would not believe.

    I feel I have been holding my position super well at times and other times I’m too nice. That is going to change as it is being too nice that has got myself involved with the court.

    I have lots of court notes, it’s just a matter of what avenue I will take and sticking to it.

    I must say you have helped a lot of the years and I thank you for all your PDFs 🙂

    I am kind of glad to be going to court as it’s only a small matter so I will learn a good lesson.

    I know Mark says it’s hard to win your first case but I feel I have been studying and role playing that I should be a winner Lol

  • I guess I could do that, I could do up a conditional acceptance form with setup questions and have my source document with it too.

    I could hand deliver it to the police station you think?

  • I did the first step and sent in a copy of my ARR license and still was summoned. I sent this to the transport and not the police station as it was the transport address on the infringement.

    I plan to just deal with it in court or hope that when I submit my documents via exhibits the prosecution will see what I plan to do and withdraw.

    I’m also thinking of going to the police station and record while I ask set up questions.

  • Ok thanks Morag, so how would one get some conditional acceptance questions into the filling? Because it’s a traffic matter, it seem a s criminal and not civil.

    I’m going to file my ARR and my source document but I wanted to add some conditional acceptance questions too.

    I have a recorder but my gf will be at work so bit hard to get a witness, I plan to go to police station soon and get the court brief from the prosecution, also record and ask if they have jurisdiction over my source document (just to warm me up) lol.

    I will be letting them know I will be asking the same in court.

    Happy to hear you took the positives out of it, this is going to be much the same for me. Win, Lose or draw i am winning because I am doing what is right.

    Hi,

    Yes I watched that one last night, I will be watching multi able times though, I am most definitely role playing and just stick to my scrip .

    I plan to just enjoy the process as this will help with my mind frame and to hopefully change the energy in the room.

    I have nailed it when it comes to all my other altercations (road siide) but my problem is I am too nice and end up trying to let them see the realm we really live in.

    I need to face reality and that is they sell their souls so what is the point.

    Thank you, I ask because in few webinars Mark (states there a problem with the court procedure and asks the judge to look at his document showing his source ID document/ARR documment) so I was not sure if you could just do that or you do that but be sure to have it filed first.

    It is always good to have it in PDF as I save it into my files.

    My plan with the police notice to appear is to go into the police station next week and ask to speak with the chief officer in charge.

    I then plan to ask them if the have jurisdiction over my document that gave rise to the birth certificate.

    Would I ask if they have jurisdiction over my licence if I reserved my rights? Or would I ask how did I breach the agreement if I reserved my rights?

    I did it all on the side of the road (the non consent) so I’m just wanting it over and that is why I asked to have it heard in court

    Yes it is very empowering to learn, I just love knowing the real system we live in.

    I do not feel like a fool and that is the most important thing for me.

    I am a novice also but am learning quick as the system does not wait for you to catch up so its sick or swim basically.

    Thank you for you story btw it is great to read other stories as it provides information in my opinion.

    Sorry to hear about your ordeal. My advise is to watch/listen to some of the Q&A sessions as mark talks about how to handle when the judge does not play the game. I am sure he mentions it in some webinars too.

    I basically listen to it as much as I can and take notes.

    I am also a big believer now of picking my battles, as I am sure you are well aware it takes energy and time to get what is right but as I said I now choose wisely.

    When I was talking about my payment options I was being the creditor, by me stating I want to settle any matter makes me the creditor, so by them denying me (via non acceptance) a way to settle the account makes them in dishonour.

    Yes I found information on that site too, I actually emailed them last year and here is their response.

    In my emails to the party I was in correspondence with I did ask, are they not prepared to provide me with a payment option that meets federal legislation? They said no and they do not have too, so I then thanked them and stated the BOE act section 48 where it states their dishonour by non acceptance discharges the liability.

    That was pretty much it after that, that party went away pretty easy.

    The party I am dealing with at the moment is really putting up a fight, I am learning so many new things quickly due to there pressure. I am holding my position well and I look forward to it being over so I can share my experience on the success and failure group.

    With the BOE sec 48 statement, because the BOE act is the principal act in Australia, I was correct to state that they have dishonoured by not providing me with all payment options?

    To me because the BOE in the principle act I guess the other acts fall under the BOE act.

    The party who is issuing the statement of account must provide all payment options. I was looking through my emails I had sent to a party in regards to asking them to provide all payment options.

    I quoted the banking act but I think that is wrong.

    I have successfully discharged that liability but I just wanted to confirm the right legislation for the providing of all payment options.

    I have done up some pretty good notices but they keep coming lol

    When they sent me the last one of a snapshot showing the original party can and has assigned a third party I got a bit worried. There is a bit more to it then that but I still held my position and sent them another notice stating that is not enough evidence to support the claim.

    I sent them another notice of non consent and for further and better particulars straight away so it’s game on again.

    I have some great setup questions but you can never have enough advice.

    I asked Mark some questions last night but they were not really the best questions.

    The next day I knew what I should of asked instead.

    I now listen to all the Q&A recordings at work, there so much information in those recordings so I’m just taking lots of notes.

    Anyway thanks again for the information as I really appreciate it 😊
