I’ve sorted this issue out. I’ve adopted a ‘for purpose only’ signature that is different to my regular signature that does not include ARR. The Application document was then accompanied with a separate letter that stated clearly that the application reserved all rights at law & equity, denying statutory obligation, and stapled this to the application together with a third party witnessing document signed by the Postal worker with their Australia Post stamp. The letter and the witnessing document expressly cited the formal Application number, and also the third party witness document ID. Duplicates were retained for evidence. The passport application has been processed and the passport is on its way & in the mail.

OK, I’ve just purchased the Promisory Note Pack and I think the question is answered in the accompanying material. My next question is can Solutions Empowerment print off and Stamp these Notes with that nice Gold stamp that Mark spoke of, and how long does it take to get this done, as I have a 3 week deadline to deal with?

Here is my situation. I am reasoning that any current contract be it Government or Commercial involving consideration that links me to the ALL CAPS name will make it difficult to maintain the assertion that My Title Case Name is not the ALL CAPS name. As such, I am closing all Bank Accounts in the ALL CAPS name including credit cards, Visa Debit cards and the like, as they deputise the bank to act in my stead for debts that I generate. (I have no standing debt or wage income so nothing lost here). I have switched all my bank transactions to one of Mark’s Trusts (of which I am Trustee).
I used my current Driver’s Licence endorsed with All rights reserved to open those Trust bank accounts. The Driver’s licence fortunately expires in two weeks well before court. When attending Court, I will therefore be able to firmly ask for evidence supporting the claim that the ALL CAPS name is myself whilst also avoiding any questions from the judge as to any contracts that I currently hold by retorting “Do you really think I would be asking for evidence if my assertions were not true”.
I was not anticipating I was going to have to do this as its a civil dispute with the QRO, but the claimant has slipped my ALL CAPS NAME into his Affidavit and I’m going to have to challenge it whether I like it or not. -
Private agreement and default judgment is in place. I wrote the Affidavit and its been filed. I will be writing a script myself & I’ve watched the vids so have a very good idea of how procedure is used & the fish hooks, I’ve also discussed with Mark one on one. I have it all mostly down.

Yes I have watched many of them Morag. I’m aware of nailing these claimants to the wall for the third time to lock in their agreement on absence of evidence, and never testifying myself at the request of a judge and how to maneuver around him. I’m just wary of the unknown. I’m tossing up just letting my driver’s licence expire before the Court appearance and filing a final ATO Return beforehand as well.

I certainly didn’t write it, so it must have been auto generated by Mark’s system. I’ve got copies of all the Notices, but obviously attaching copies of them as a schedule to the POlice Notice seems over the top. Is there a short form of that document that is attached as the schedule?

So its on the spot to avoid arrest if they get unreasonable despite my questioning of them. I’m good with all the questions to fire at them over Jurisdiction & Application of the law, but this is a measure to make them go away and present paperwork through the mail.

OMG I am reading the files in Module 17 that cite some very arduous scripts with court participants. Whilst I do have a rudimentary understanding of the principles at stake here, I doubt very much I am going to be able to pull this off with no prior court appearances. Even if I drill myself with these scripts, I still doubt my ability to be able to continue pushing the full 100 yards if the judge pulls out all stops and continues to use trickery to hook me into testifying or making a claim I cannot substanciate. The other potential problem I might have is that I was on helmet camera during my interaction with the officer, and I asked the question if I had missed a bill, then did not state clearly at the time that I did not consent to doing business with him, and was only vague about agreeing to being forwarded a fine suggesting that if he was going to send anything to me he could use the email in the system. Should a just back off and pay?

Bill due 14th Aug, I presume also this is the sunset for applying to take it to court. What I have my eyes on is the submission of the affidavit and not sure that this has to be on the same day that the application is made or can it be done in the weeks after the application is made?

Yesterday I received a lettered reply from the Officer I addressed telling me he was not withdrawing the offence and asking me to pay the fine. This is only 4 days into his 10 days notice, I am thinking I should use this opportunity to shoot off the first default Notice immediately rather than wait for the full 10 days as time will run out on me in the leadup to the sunset on the payment & responding to the court invitation. Will responding with a second 10 day notice immediately cause legal issues with the 3 notice procedure?

Based on what Mark is saying in that webinar, it appears that opening the Police Notice is no issue when you are doing the 3x Noticing of the officer involved re my “All Rights Reserved” status. I will likely wait to recieve the Police Notice so I have a name and an address to respond. (unless you can convince me otherwise). Separately, my old man stuffed up when he filled out the Birth Registration Application form (that Mark has specified should be included in the Notice). He filled out my name in ALLCAPS which undermines my legal approach to alienate myself from that name. I do have a Christening record signed by 3 people months after with my name in Capitalised English, but this would not likely be accepted by any court IMO. Can always give it a try.

I surrendered Licence, he confirmed bike was 24 days overdue, advised me he put a permission to ride until 4pm and said a notice was coming to me via email

I used Heritage Bank up at Chermside. Portia up there was very helpful and there were no hickups whatsoever. Got my account established & EFT Visa card delivered soon after.

This document is massive. Are there any materials that SE have to navigate these? I was looking on YTube and found an English Barrister who has a course on understanding the Civil Procedure Rules in the UK. Is this worth paying for to get a 5,000 foot view? I guess for me personally, just reading the Qld Rules with all its nomenclature will be like attempting to read a Greek Text without a guide. What do you think?

MemberMay 16, 2023 at 10:17 am in reply to: QRO Refusing to Stamp Family Trust Property Transfers Exempt from Dutystart studying how court works and the scripts etc… ie the text of your prior comment above… if you are competent and the right questions to ask then an outcomes can potentially be a private meeting with the adversary where the judge expects them to come to a private agreement with you and make sure you are treated equitably. If you learn this process to add to what you have already learnt you will have a much higher chance of success….

I have already asked Mark via Email if this is the appropriate way to move forward, but he has been too busy to reply. Once again, I am concerned that if I receive no reply that the Supreme court will close ranks (as they have with other petitions) and refuse to issue an Ex Parte Ruling against the Government.
