    Hello Janet, Long time no contact.

    I finally found a home and put in an offer, which was accepted. I am buying it as the trustee of the trust (as you mentioned before). I signed the contract with ‘without prejudice’, so let’s see if they accept it. If they don’t accept it should I just walk away seeing that the titles are being destroyed? What do you think? Of course I like to have my own home, but if it is too risky, I can wait to see how things work out.

    Oh dear, that’s interesting.

    So, only if I took power of attorney it would be ok?

    I’m not keen to do that for that reason.

    What about if she sets up a simple letter asking them for evidence of their authority? So nothing elaborate?

    Hello Janet,

    I’ve uploaded the final notice for your perusal. 🙏

    Seeing that the lady does have mental health issues, I wonder if it is ok for her to be her own representator, or would they dismiss it for that reason???

    I was told that I could do it with Power of Attorney, but I prefer for her to do it as they may, and probably will, attack me. I just don’t have the time to deal with that as well …. What do you think?

    I wonder if I have to put the doctor’s name also as a living woman (kathryn is as a living but the doctor is not. I thought a living can only interact with another living.??)

    Hi Janet,

    Yes, I’ve completed it but would have to re-type the whole document.

    Whilst I’ve got you…. I am going to see the Psychiatrist of the lady on the medical treatment order and have attached the notice of liability I will be using.

    Mark mentioned, last Q&A, to use an Affidavit of Claimant with it. Do you think it’s vital to have that affidavit or can i start with the notice of liability (attached)?

    I am certainly an expert and hope that someone better equipped will answer. I just noticed that , on page 3, it says:

    delivering a copy thereof to the defendant personally at:
    *(b) leaving a copy thereof with
    for the defendant at
    *the usual place of * residence/ *business
    *the place of *residence/ *business last known to me

    You will also need to get the affidavit signed by a JP.

    Thank you for the response. 🙂

    I am actually the one who had that success and wrote the testimony.

    When I tried again for my tax 20/21 they didn’t send me a check, but merely send me a ‘Notice of
    Assessment’ showing that no tax is due. However, they didn’t send me a cheque like last time. Hence, I am wondering if a simple letter, requesting a refund for the payee will suffice?

    I also have a trust account with the Cb and my name is also on the card before the trust name. I also just read somewhere: Q….When we get a debit card for the trust
    does the name of the trust need to be on the card or our name/s?
    A….ONLY THE TRUSTEE NAMES

    So, it’s ok to have your name on the account as well.

    Hello Janet, I just read through the thread again and wonder if it is possible to sell a property to the ‘living being’ with a Bill of Sale for e.g. 1 dollar, so to avoid paying stamp duty? If that is possible, would there have to be any other paperwork with it or just the BOS to the land registry office, or an affidavit as well?🧐

    I just noticed that you took out the living woman. Wouldn’t that be all needed to make it invalid, or am I, essentially, working towards the ‘lack of royal ascent?

    Yes, i did the affidavit. I’ll check if i can access it again on the website.

    Hi Janet!

    I took the Trust papers to the bank and told them to make a copy from the pages they need. They did that and then they opened the account. I was asked to sign twice (I couldn’t see what I was signing as they told me to sign on an ipad). I then asked me to show me what I had to sign and it merely showed the name of the Trust.

    I’m not 100% sure that there aren’t any other things I signed, so I added all rights reserved, but they wouldn’t accept that.

    Anyhow, I now have a Business Transaction Account with my Trust name.

    Hello Wehah, I opened a Trust Account with the Commonwealth Bank and it was not a problem. I had to give my TFN and sign that I’m a tax resident. Anyhow, as Janet sent you the Q&A, providing your TFN is not an issue.
