    I’ve been giving it a lot of thought, and have decided to do the following:

    1. opt for the option to take the matter to court

    2. before the court date, send 3 notices of my non consent and offer to conditionally accept upon proof of valid claim. This will create an agreement that they have no claim.

    3. submit the evidence/affidavit of no claim along with my all rights reserved driver licence and birth source document

    I expect that if I do the 3 steps above the matter will be thrown out of court before the appearance date.

    Is this a good strategy? I’d like to know your feedback/suggestions.

    Hi Catherine,

    I have a friend who is also having difficulties getting a hold of Peter, by email, by phone, or by his website (which is down at the moment).

    Unfortunately, I don’t know anyone else that you can contact that can help you to get in touch with Peter. Peter set up my foundation and he was the only person I ever dealt with in the process.

    Hi Yort,

    My brother-in-law is working with Peter at the moment to set up his foundation. He’s also having issues getting in contact with Peter. Peter will eventually respond but if your emails are bouncing back then it would be best to contact him via phone. I’ll send you a personal message with his number.

    I set up my foundation with Peter a couple of years ago, and my daughter about a year ago. My daughter ended up getting her foundation bank account set up with ANZ (so did I), and I have also had success setting up a foundation bank account with Great Southern Bank.

    If you follow the instructions from Peter you can set up the bank account yourself.

    Hi Thomas,

    Since April 2022 I’ve been running my enterprise through a private foundation (set up by Peter Duff). When invoicing clients for the first time, I send them my invoice (no GST is included – it is labelled an ‘Invoice’ not a ‘Tax Invoice’) and also a completed ATO form – NAT 3346 and tell my clients that they are required to keep that document filed for 5 years. They don’t need to submit that form to the ATO.

    Peter Duff gave the instruction to send the ATO form and also gave me a template for invoices.

    Have never had any issues. Some clients ask me about the private foundation and that gives me a good opportunity to tell them more about Solutions Empowerment.

    I’m not sure if this applies to sending out invoices from a private trust.

    Hi Catherine!

    I have both my trust and foundation accounts with one bank – Great Southern Bank. I had no issues setting it up…. however, when my daughter tried setting up her foundation account they knocked it back (at a different branch to mine). Very inconsistent.

    Hi! I haven’t tried to set up a superannuation fund that is linked to a private trust nor a private foundation but I don’t think it can be done. Not that I’ve tried, but my understanding is that it would require you to register your trust (make it public) before you connect a superannuation fund and your trust together. At least temporarily – you could let the trust public registration expire – but even then I don’t know if that would be an ongoing problem?

    We have both a private foundation and a private trust, and a SMSF, but none are connected.

    Thanks for sharing your success story Merlin!

    I just got an email today from our electricity supplier giving me the ‘good news’ that our meter will be upgraded to a smart meter on August 30th 2024. I’d like to send them a reply… I’m not sure if it should be a notice of non-consent, or a conditional reply.

    If anyone has written a reply that they would be happy to share with me, or a template, it would be very much appreciated.

    Hi! There shouldn’t be any issues except you might find it hard to register for public platforms if you don’t have a government registered business. It can be done (I was able to get a bank account and a stripe account for our private foundation) but it can take a bit of explaining to help the public platforms (like Airbnb) to understand your entity.

    And sometimes their policies can change, or it will depend who you speak with in an organisation.

    For example, I was able to register a .asn.au domain a couple of years ago, but when my daughter tried 6 months ago, they wouldn’t let her.

    There are workarounds if you do hit a roadblock. For example, if they require some kind of government registration to set up an account, go ahead and get the government registration, but when it comes time to renew, just let it lapse.

    I just called the NSW Land Titles Office again today and a second person there confirmed that due to legislation passed in October 2021, they will only accept electronic lodgement of forms, through a system that is only accessible by licensed conveyancers and solicitors.

    I asked if I could come into the office in person, but was told that it wouldn’t make a difference.

    My trust is private. One that Mark made for us. The NSW Land Titles Office have said that they have moved to electronic submissions only now – no other option. You have to make changes through a conveyancer or a solicitor who has access to PEXA.

    I’m looking for recommendations from members who have used a conveyancer or a solicitor to successfully transfer/purchase a property in NSW to their private trust.

    Judging by the wording of the document, the 2 witnesses need to be there with the JP and they all sign together.

    Thanks Morag. I’m just really confused about how it should be filled out based on whether you use a J.P., and if witnesses are necessary, etc.

    It is okay if I send you the document and you put in some fake names, etc so I can see what the final outcome should be?

    I haven’t bought this Module, but I have seen this webinar many times.

    I purchased a private trust from Mark, and now am in the process of purchasing some land in NSW. I was wondering if anyone could recommend a good conveyancer to work with?
