    Hello there. I am not going to give you too much help as like you I am a novice although I have gone to court a couple of times. Last time I represented myself but unfortunately the judge wasn’t on my side. I do know I did a few things wrong such as not asking questions. So when asked by the judge something like why have you not paid, answer with something like Have I not paid to the tenor of my acceptance as per S59 and S60 of the BOE Act 1909. Research on here Holding your position as it gives a lot of help in this area. I also did an affidavit but unsure if the judge bothered to read it. You send it to the court at least a couple of weeks before you attend and attention it to the registrar. In my affidavit I wrote I am the living woman as a point. I also wrote I do not recognize my all caps name and I am the beneficiary of my all caps name. This is letting them know that you are there representing your trust. Anyhow as I said I have limited knowledge and hopefully someone else will give you a bit more advise. Good luck. I was told do not stress but I found that a bit hard. Try not to if you can. Just remember always answer a question with a question and ask it 3 times. If they do not answer you can answer for them. Silence is acquiescence as they say. Cheers.

    Yes I asked if they could read and pointed to the signs. I also advised them I have written to the council numerous times and advised they are not to enter my property and clearly visible signs are erected which advises no one is to enter my place unless by invitation. As far as I can see I have done everything ad I should have but they ignore it and continue to do so. As mentioned I could not record it as they caught me outside and I didn’t have my phone on me. Now telling me they will once again enter my place to steal my pets. This is why I am getting frustrated as they continue to flout the law. Create court cases that are not valid. Have me fined by a judicial registrar who ignored every ounce of evidence I provided with an affidavit and a large amount if supporting documentation. I have put them on notice they ignore it. I am getting so stressed because not 1 thing I do has worked even though I have seen everywhere if you do this it will stop them. I do know I can take the to court for trespass but am struggling to know exactly what I do, hence the reason for this post. Every time I start to try to find out answers the council do something else so I have to sort that put and then it creates another problem. My lack of knowledge is what allowed the judicial registrar to do what he did as rather than ask questions I just continued to tell him I do not consent, so he muted me, found me guilty and that was the end of it. I would like so bad to take them to court but I do not know where to start. I have paid the fine with the BOE so I need to learn how to hold my position but then they say we are going to steal your pets. I am going around in circles and so far have not had 1 win. I am going to pay the dog and cat rego just so I can get them off my case and focus on everything else but so far I just find everything I am doing is getting me nowhere and further into a pickle. Knowing I have done everything I should is little comfort as they continue to harass and screw me over. As I said I am so stressed as what started out as a simple thing has now turned into a huge drama. If I saw 1 thing work I would get some satisfaction but nothing. Last night I completed a letter to the Governance dept of the council advising I am going to take them and the person hassling me to court. I also added my fee schedule and an invoice but I am positive again it will be ignored. I am doing my best to stay positive but finding it very hard. As I mentioned I am on workcover for mental health and all this has exacerbated my anxiety and agoraphobia. I will not give up but just want to go forward. I feel like I am drowning and in a downward spiral. This is why I asked for assistance. I cannot keep doing the right thing and they just ignore it. Sorry not trying to be dramatic even though I know it sound like I am but just cannot see or know what I do next. How do I take them to court for trespass and is it worth trying to when my knowledge isn’t the best? As I said any advice appreciated. Is it worth speaking to the solicitor on this site? Is he aligned to the bar or will he support me? Yes I do understand doing it myself is the best but not sure I am at that point just yet. Thanks Morag 😖😊

    Hello again Morag. Yes I have 2 different signs up which both clearly state unless invited no one is to enter. I will send copies through in a minute. I was caught off guard with the last trespass so no unfortunately didnt have my phone/camera on me when they turned up. I asked them at least 6 times to leave but they stayed at their will. My security camera captured an image if the trespassers when coming to my front door. Previous trespasses I wasn’t home and the first time again I didn’t have my phone on me. It seems the universe is against me here. 😊 I didn’t record the zoom meeting as it ended up being a phone in because the zoom link wouldn’t work. I have though obtained the transcript of the court case. I was unsure about the offer of a fine from court. I didn’t open it for around a fortnight but in the end when I did the BOE I did open it so I could turn that into a contract. I sent that through to Fines Vic yesterday. I have been trying to learn all the processes. I am currently on the hold your position as I have no doubt that I will be dragged into court again for ‘not paying the fine’ so am trying to ensure I have all the answers if that does happen. I do understand I can take them to court for trespass, harassment, and possibly coercion and extortion but am too unfamiliar with processes and as I said earlier do not want to mess it up. Hence the reason of asking if there is some way I could get assistance. As I know everyone says do not be fearful, and in some sense I am not, but I do get terrible anxiety and it makes it hard to appear confident. I took the state govt to court for bullying and harassment and won that case but am still suffering the effects of their treatment toward me and my bosses actions. She actually assaulted me and am still unable to work due to it all. This was all made easy by having a solicitor. I am today going to sign ownership of my pets to my daughter and register them with her Shire so hopefully that stops them harassing me but I do want to take them to task as I mentioned earlier. I just do not have the confidence or knowledge to do that and have decided I will have to just keep studying and learning. Was wondering if it was worthwhile paying for a consultant but think for the time being I will just leave it and atm myself with knowledge. As they say knowledge is power. I have tried searching up info on taking someone to court for trespass but all I see is advise on how to find a solicitor. I do not know where to start. I have 3 years I believe so will just keep banging away at it and hopefully get the knowledge and confidence I need to take the matter to court. I didn’t actually realise the degree of corruption across the board and how hard the fight would be even if doing everything correctly. Thanks again Morag. Cheers 😊

    Hello there and thank you so much for your reply. So I have 8 trespass signs around my place. Council have just ignored them. They are a law unto themselves. I am going to register my dogs with another council. For the time being I will stick to a local council much to my own disappointment but the council is out to get me. It will make it hard for them to do anything if I have paid registration and given up ownership. I am just feeling very frustrated as I have done everything that should have stopped it before it even went to court. I have put the council employee on notice, I have declined offers, I have done absolutely everything that I believe would have stopped the harassment but it continues, hence the reason for giving up ownership to my daughter. I hope that once this happens I can focus on taking this scumbag to court for trespass but am a novice and need to learn so much more to be able to do so. My head is whirling, this whole situation has been a huge nightmare. Here was I thinking that I could stand up to council but it is quite apparent that it appears not. Oh well onward and upward. Head down bum up as they say and endeavour to beat the bastards. Thank you again for your reply. It is great meeting like minded folk on here who are prepared to help others out.     Well that is interesting with regard to not getting a court order. I do suppose I could just decline the offer but think I will go through with the BOE. It will give me confidence to perform it again if I should find myself in a similar situation. I will purchase the BOE package as the more information I can arm myself with the better.     Hello again Morag. I see the Q&A you sent through answers some of my questions. I will print out and read better a little later on. So the fact I have not received court orders suggests there is no contract, is that correct? If so do I need to request them from the court? I will consider purchasing the package to assist as it will help me get it completely correct. Thanks again 😊

    Thank you Morag. I really appreciate your assistance. No I have not to date but have watched Mark’s webinar on this process a number of times. I have purchased my linen paper and stamp pad etc so I can get cracking on this one. My fine is for unpaid dog and cat registration. I did everything I should have in an attempt to have the case dismissed such as putting the informant a notice and also sent the courts an affidavit etc. but everything was ignored, the case went through and the judge found me guilty even though he never contracted with me. I have lodged a complaint with the judicial commission and also IBAC. Today I collected a transcript of the court case so I can persue it further. Nonetheless I now have received the fine but as I mentioned am yet to receive court orders. Am doubtful I will, Kangaroo Courts. So this is my first attempt at having a liability discharged using the BOE method. A friend who is also a member here has been assisting me as well so am fairly confident of the process. I live out of town and it would be far easier for me to post the BOE to them. I have been told once accepted by the Magistrates Court I send through the receipt (which would be the registered mail acceptance) to Fines Victoria. Just like the court case am doubtful that it will be accepted and can only presume that I will be hearing from them again. Would it pay to put a letter in with the BOE or is it alone sufficient? I am currently going through the ‘holding my position’ section/module as I am sure I will be required to do just that. I will keep you informed of my success. Thanks again Morag. Cheers Linda 😊

    Thank you Danny. I too am a relative quick learner. I understand being confident with all of this is a challenge but as I said to Morag I am determined so that helps. I have a friends who has also assisted me greatly and have watched many webinars on all things sovereign. Peter Stone says no one can help you, only you can help yourself but believe we can all help each other by pointing people in the right direction. Part of the problem is there is so much info to trail through so finding g exactly what you need has been a bit frustrating. I have also got to the point where a lot of stuff AI watch is repeating what I already know but still useful. I look forward to the day I am confidently sovereign 💪🏼💪🏼💪🏼💪🏼

    Oh thank you very much Morag. Really appreciate everyone’s help. The more info I can arm myself with the better. I am a novice but slowly learning. One thing I am blessed with is determination.     Thank you Danny, yes I am listening to as many webinars as possible. My honest belief is the universe was telling me I need to know more to win battles. Still extremely frustrating as I believe I did everything correctly. Kangaroo courts. As this is my first real attempt to challenge jurisdiction and authority I am not too upset. More bamboozled that a judge can completely ignore his own rules. I will continue to fight to freedom and have no doubt at some point I will succeed 😊

    Just watched the video and it is some what helpful. Can see where I possibly went wrong in a recent court matter I had. I was summoned by local council for unpaid dog and cat rego. I advised council of no contract but they continued harassment until they summoned. I put them on notice but they ignored all contact. I wrote an affidavit and supplied to the courts all details of attempted negotiation which stated if I did not get a response within x days with accord and satisfaction matter should be dismissed. Court ignored everything. I phoned into court (long story) and when asked if I plead guilty or not I said I am the living woman and beneficiary of my trust. I decline the offer to contract or joinder and waive all benefits on offer. Judge kept trying to get me to contract but was not successful and I continued to state I decline the offer etc. In the end judge muted me, and found me guilty. I see I should have challenged authority and jurisdiction which may have helped although it appears judge completely ignored rules. I have lodged a complaint with 2 bodies but am doubtful of assistance. Do you have any suggestions for possible remedies? Thank you 😊

    This is possibly slightly off topic. Was just dragged through the courts even though I did all paperwork prior to ensure matter didn’t go to court. Put the plaintiff (local shire council) on notice but they completely ignored all attempts to negotiate. Sent through an affidavit to the courts including all info of negotiations prior. Matter should have been dismissed but it proceeded and long story short was found guilty even though judge never got me to contract. Have lodged complaints with both IBAC and Judicial Commission but not holding my breath for assistance. Any suggestions for remedies in this?
