    Hi Brian, i also corresponded with David Allen but as per usual NO REPLY. I was off the thought that the money order that we send through is from the trust funds that they have started and matured over our time here on earth. Hopefully I’m correct as i utilised the payment slip at the base of the statement. If at any point ato threaten us to pay via our actual hard earned physical play money isn’t that extortion? From my learnings everything we have has been pre paid hence its on a statement that they send us to balance the books on thier end.

  • Greetings SE family, i have completed the full BOE A4V Money Order Process to discharge a liability penalty up to and inclusive the form of protest in the back of BOE ACT to the AT0 and i now have recieved this letter stating to contact them by 11/11 so they “CAN PROGRESS THIS FOR YOU”.

    All correspondences have been to David Allen as well as CFO Janine Bristow via registered mail originally to 26 Narellan Street Canberra but the last statement i recieved i had sent it to David Allen at Albury (different address).

    Has anyone been up to this stage and if so any ideas or information to guide me further through this process would be delighted.

    Look forward to hearing what others have done and achieved.

    I had a look at the trust mark writes up and I’m trustee with the wife, I’m principal as well as primary beneficiary with the wife too, if that statement is correct mark would’ve picked up on that as well as known not to pop me down as primary beneficiary either wouldn’t he??

    Hi Brian, how are you?

    Is the cheque you sent attached to a bank account? (hopefully not a silly question as I might be assuming). As I had filled in the payment slip at the bottom of the ATO Statement and sent it back to them, I used my reference number as the money order number. Hopefully I’ve done it correctly.

    Hi Janet how you be this fine day? I am still negotiating with my client for a contracting role but it seems like the ato have added new terms on their site stating that if a contractor does regular days and hours over time that they are deemed to be classified as an employee and that the business that takes on the contractor is liable to withhold tax behind the scenes. The client is keen on taking me on but I feel and respect that he has to not put his business in the spotlight which I can relate to. Any ideas that might come to mind to assist in finding a way around it?

  • Hi brianchu82, how are you going? I have received a response from ato to contact them as they need more information so they can progress this for me. I was on the phone for round 50min and I did state to them that it is recorded and I felt I handled it well with being super polite. Bodie and his supervisor Tim had suggested I go through their “complex advice request” which code they have on their website is 50504. Have you or anyone else been down that path? if so what might I be up for?

    Important Note: The Trustee must hold Legal Title and the Beneficiary must hold
    Equitable Title. Neither party can hold both legal and equitable title at the same time.
    If a party does hold both Titles, it is not a Trust. Holding both is called an Allodial Title.

    Is this statement correct?

  • Hi Morag, my situation is slightly as a contractor role through my trust to a public company hence the question that the owner of the company is asking whether he would have to pay more to the ATO at a later time.

  • Hi John, hope all is well. I have gave samples to the owner of the business with a dummy invoice and the form 3346 but his questions are can he claim against my invoices on his BAS and would he have any other outgoings to ATO as in the way of any hidden payments that would cost him more than employing someone on the books over contracting me?
