I am helping in a case where a child is involved. The mother has had custody through out this battle and the ex who is a violent offender and has numerous other charges against him keeps dragging this through the courts with lies he fills his affidavit with. So I am currently working to rebut them with evidence so they cannot not be used again. But what happened this time is she was ambushed in the Foyer of the family court by the ex partners Lawyer, the ICL and her legal aid lawyer who had eailer all met in small room together and they came out and told her to sign this document with all the ex’s terms in it, which she had no understanding of, and if she didn’t she would lose her daughter and was threatened by the Legal aid if she didn’t he would not represent her. this continued on for half an hour at least. She has A.D.H.D and told him she doesn’t understand it properly. She said I don’t consent because she remembered I told her to say that if she did not consent to anything and actually said it 3 times. But she signed because she didn’t want to lose her daughter. Then they all went into the court and handed the judge this document, which had NO DATE, Names all spelt wrong, words crossed out and not initialed and the Childs birthdate completely wrong. And the Judge said, So she actually signed this? and who are these people on here and the mother said I didn’t want to sign it I don’t know who those people are. The judge said well you did and now you have signed your daughter over to the father until the next court case. So would this doc that has no date and spelling mistakes and as she was coerced to sign it and signed under duress, would this be an invalid contract? Can we have this over turned immediately?
