  • Moving assets to the Trust

Posted by joerg-m on August 30, 2022 at 2:31 pm

I have set up our Trust with Mark / Solutions Empowerment and finally set up our account. Now I want to move all our assets (like cars, cash, investments), money from our private accounts, precious metal, computers etc. basically everything of value in the trust. Do I need to add a note to the Trust deed or how can I prove this else wise? Want to make sure if someone comes around and wants to lay their hand on it, that I can claim that this is not mine but belongs to the trust. Is there any template I can use to make this as simple as possible? Or is this just a formless note signed by all the the principals and beneficiaries?

I think “chattels” can be transferred by just noting they have been in the minutes. I asked this question recently about copyright I own and Mark said it was just a case of noting in the minutes.

Larger things that have been state registered seem to vary quite a bit depending on where you are.

An aside, I don’t seem to be able to choose who to reply to on this thread, so not sure who it’s going to state I’m replying to – but this was for the OP!

Thanks a lot for your reply Jess. Now that you mention it I recall that Mark mentioned that. Fair enough it it is that easy. Will set a minute document and then add it to the folder in the deed.
