    Hi All,

So I am after info on weather or not there is a time limit on being summonsed?

The story is that at the start of July I requested via my online government account to have a infringement heard in court, I have not heard anything back until today when I had the cops come to my door with a summons.

I would like to ask if there is a time frame in which they can not pursue the claim anymore, I mean it has been 2 1/2 months.

Thank you if you can help with any information.

I am not 100%, but I think it is 90 days and then another 90 days to process in court, unless extended again for another 90 days. I read somewhere they do them in 90 day block timeframes, but it was in a law article a while back and it stuck out.

Hi Danny, I read somewhere that it is 12 months.

For your info; when you ask the matter to go to court, you’ll be the one paying, so always let them take you to court!

If you are in Victoria, you can rely on the Imperial application act of 1980 Sec. 8 paragraph 12

It’s unlawful; in breach of fairness and judicial process.

Yes, that was not the best idea, but it’s done. Did you do a conditional acceptance or anything like that?

No because I feel they will still just go ahead with whatever they want.

I did it all on the side of the road (the non consent) so I’m just wanting it over and that is why I asked to have it heard in court
