  • Dealing with insurance companies

    Hi everyone,

    Looking for some advice regarding a car accident I was involved in the other day.

    I was reversing out of a car spot in a shopping centre, I have a Ute with a big toolbox on the back so I can’t see out the back windows. I was looking in my mirrors and edging out slowly when a lady must have tried to speed past and I hit her, my car actually moved sideways about a foot she was going that fast. Anyway we swapped numbers. My car wasn’t that damaged but hers was quite bad, the whole side of her car. Had the police rock up today, she had wrote down my number incorrectly, sorted that out though. I know “legally” the insurance company is going to say I’m at fault. Morally though I don’t agree. She took no care while driving while I was being as careful as I possibly could. I have full insurance and so does she, but my car doesn’t need fixing. My question is any advice on how should I deal with the insurance company? Im assuming they will be calling soon requesting my policy number. Do I instruct them to send me any correspondence via post or email. Which I assume will be to the ALL CAPS name. Pretty sure there’s CCTV of it all as that’s how the police tracked me down. I’m not trying to screw anyone, But at the same time I don’t want to get screwed.

    Get the CCTV as quickly as possible then you may have evidence if she was speeding in the parking lot. If you can prove she was at fault then her insurance company will be paying for the damage, if you can’t, then your insurance company will be paying.

    Legally they will still blame me as I was reversing. Camera would definitely show her driving over 10km. She doesn’t have my insurance details, they have my name and phone number only. I haven’t lodged a claim as my cars okay. I haven’t even heard from them or their insurance yet. If I do should I just tell them to send all correspondence via email or mail? I’m assuming it will be addressed to the all caps name.

      We had a similar accident and we never heard from them again as we are assuming the excess they had to pay and losing their no claims bonus made it non viable for them to process the claim. Maybe that’s why you haven’t heard from them?

      If you do hear from them, yes they will address you by the Birth Certificate name. You can specify where you want them to send their correspondence, yes and it is up to you where you want it sent. As long as you keep a record of the email correspondence it should be ok that way and more easy to deal with. Just write your response and sit on it for 24 hours before you send it so you have time to make any changes you might think of overnight.

        Thanks. I still haven’t heard from them but if I do I’ll do what you suggested.
