General Q&A: 24/09/2025

00:18:01 Bill k: Q: My wife paid $8,000 cash for an RV from a U.S. dealership. They said they did an inspection on it, but within a few days, the AC was barely working. She spent $1700 to fix it. The technician said he nearly fell through the roof & it would cost several thousand dollars to replace. The dealership finally offered $1200 toward the roof. An attorney said he could sue them, except she signed an arbitration agreement upon purchase. I’m going to send out a series of 3 demand notices for the AC & roof repair as well as $50 / phone call & $200 for coming down in person, (no one with authority would talk to her so she made the 2 hour round trip drive). Is there a better way to handle this?

00:18:50 Ivan: Q: I bought the Executor/Beneficiary Module (92). It seems there are documents missing such as the Instructions and Certificates of Mailing that aren’t in the download. Is that a mistake? And do the people who have bought the modules get notified by email when there are updates/additions to those modules, if not can your tech guy automate this so we have the latest documents?

00:21:40 Vas: QUESTION: My driver license is signed All Rights Reserved, although it’s hard to make it out without a magnifying glass…! I’ve turned a speeding infringement notice into a contract on my terms and returned it with an offer letter and 10% cheque payment which was banked by Fines Victoria. Is my offer letter with cheque/contract considered the first notice and then I follow up with second notice and final notice of default with fee schedule? .. I will continue with my 3 notices and Fines Victoria will likely send their second & third scary letters with added costs so should I elect for court before their final demand due date after which it goes to enforcement warrant stage and Sheriff threatens to come take my first born child and other possessions?

00:22:31 Vas: QUESTION: Is an un-registered Trust recognised by a court or have any legal standing in a court? Does Trust Law offer any protection for an un-registered Trust?

00:23:23 Daisy Doone: Question… When you have attained your private default judgment through PAP, and then you do a fourth notice, eg Notice of Respondents Acknowledgement of Contract, now is this private default judgement, a contract or an agreement? Because do you not need two signatures for a contract to be valid? But you do not necessarily need two signatures for an agreement? Would this really stand up in court?

00:24:43 Chris Timbury: Q: How did you go with your directions hearing? Did you manage to record it? Will this create case law when you win or be adjoured sine die?

00:30:45 Daisy Doone: Question….WHAT does “we will pursue costs on an indemnity basis?” Actually mean?

00:51:56 Daisy Doone: Question….. but what if when you give the 3 notices, on your own paper, and there is no corporate seal from them because it is your paper? So how do you stand there if there is no corporate seal because it is just written out by yourself. So would that be an agreement or a contract?
