Hi. I paid only for council services we actually received for the last 2 quarters, and just received a letter from Recoveries today. I had to open it as there was no RTS address (sneaky). I am attaching a return to sender sticker and sending it back. RETURN TO SENDER – NO CONTRACT.
I’ll have another letter similar to the letter to Credit Corp below if they try again that will seek further and better particulars, conditional acceptance on the stipulation that they provide evidence of the wet ink signature contract between them and ourselves.

It’s so annoying that there are cheap, renewable, endless sources of power suppressed while they push their agenda. A local windfarm has a B-double fuel tanker deliver diesel 3 or 4 times weekly for the diesel generator to supplement the power supply. Not to mention the power required to start the wind turbines?!?
On a different note, our family have avoided jabs but eldest son had many PCR swabs. We live on acreage and have quite a few friends, neighbours and a few relatives who are starting to question everything – council, driving, tax, banks, health, skies, 5G. Between us, we have food and services to help others and are working on self sufficiency. I believe it was easier to resist in the country, away from city pressures.

TFN is the EIN, but there may be some who only have a CRN if they haven’t been employed and/or never entered the tax realm, eg if they only work for cash.
I used TFN and CRN on A4V money orders and some add a Cusip number if they know it.

I noticed the same thing yesterday and closed it. I called the automatic line to order a paper form instead, but remained silent when it asked for the voice recognition. It went through to options and I completed my order. I’ve asked them to send any paper forms they claim we may need to complete, and sent a notice that we don’t consent to surveillance tools such as Mygov and Digital ID of any kind, and if I check it’s in no way to be be taken as our consent to contract. There’s been no reply

Thank you for your positive story. I too, have found the 3 step process works. My encounter with Telstra stretched to 4 including invoices for loss of service and nuisance calls, but the latest registered letter sent ‘person to person’ on 24th February was returned to me today. I haven’t ‘paid’ for the account with ‘money’ since November, although they sent a few emails to attempt to contract. We still have service, and haven’t received any site-specific loss of service or spam calls for nearly 2 months. I’m wondering if I should return the last letter to Vicky Brady in a plain letter and see what reaction there is, or leave sleeping dogs lie? Any thoughts?

MemberMarch 29, 2023 at 10:49 pm in reply to: ATO fines for late submission of a business activity statement disputeThanks for the reply. That’s a very impressive initiative. I can only speak from experience with individuals or partnerships. You have a situation where your corporation is dealing with another privately owned corporation, the ATO. Perhaps seek advice in a message to one of the admins. We politely cut ties with our accountants as we were not paying any more to the corporate pirates or their nominated agents. Good luck with it. I’m curious to know the outcome.

MemberMarch 29, 2023 at 10:24 pm in reply to: ATO fines for late submission of a business activity statement disputeAre you a sole trader or partnership? Mark has a good module on dealing with tax. I have some issues with a tax liability from a defunct partnership and I can’t close it because I won’t use MyGov. I discharged the balance last year with a non returned A4V money order, but they haven’t zeroed the account. They claim not to have received returns, but they refused to collect a registered letter with returns. My last letter rebutted their fines and they haven’t replied for weeks. I asked for evidence that they are a court with the authority to impose fines and penalties, according to the High Court ruling. There’s been no answer. It’s an ongoing game, but I’m not giving up.

There was a video of CO² readings being taken, ranging from quite low to supposedly dangerously high all in one full room. Possibly Tony Heller or Patrick Moore and probably deleted now. It’s just another sensationalist lie.
-
Plants suffer from low CO² levels. We are all carbon based life forms. Has ‘critical thinking’ diminished to the point that zero carbon doesn’t raise alarm bells? We are the carbon they seek to destroy.
-
Perfect summary of his hypocrisy
-
Tony Heller has a wealth of material. Climate changes. There’s no controversy in that statement, neither is there controversy in stating that pollution levels should be reduced, to zero if possible. We know climate has changed over time, and that pollution is not desirable. But they need to divide and conquer – enter man made climate change.

This is what I have penned so far. Any suggestions? I could have written 5 pages, but thought simpler may be better.

I haven’t had a chance to research yet but I’m guessing the answer would be no. I know the Queen never had a conversation with us regarding changing the conditions of our Fee Simple title either. I’ll be looking for cases of precedence. At least it was addressed to us, not just a generic response

We received a fine for overdue lodgements that I sent last year, but the Registered Letter was never collected or returned. I also notified them 3 times, I cannot use mygov, so if they need me to fill out forms, they must send hard copies. As to the fines, I sent a conditional acceptance based upon evidence that they are a court with authority to impose fines according to the high court and not a (private?) Corporation. I’m waiting for a response.

With a little more research, there may be another form or two that should accompany it to do the process properly in the first place, especially 1099C to cancel the debt and 1099OID – original issue document to reclaim payments. There’s more to the process, and some have encountered vexatious claims too if it’s not completed correctly.

MemberFebruary 23, 2023 at 10:25 pm in reply to: All rights Reserved signing and Alternative PassportsUpdate. I updated my licence details to a c/- address and my autograph on an electronic pad that ‘crashed’ 3 times when the girl tried to save it. It was nearly closing time so they were keen to finish the transaction. I have a record and they know I’ll be back if it’s not correct. See what arrives.

‘To the best of my knowledge’ is added on certain letters and documents. Is there anything wrong with signing with Beneficiary?
There’ll be a copyright symbol soon too.

MemberFebruary 17, 2023 at 9:17 pm in reply to: All rights Reserved signing and Alternative PassportsUpdate on driver licence renewal- I had a conversation with Main Roads who had never heard of an agency using a different photo. They used a photo taken from my Working with Children Blue card with my old signature. I asked why would they do that when it’s not a licence photo? It was the last photo on record in government records. So why wasn’t the photo taken on 30th January saved in your records? After several calls to her supervisor and the office in question, I’m assured of a free replacement card with my details as supplied (I’ll definitely scan it this time) except she says the name is always in capital letters. Is that true?
They get nervous when you want to know the name needed if I lodged a complaint for breach of contract.
Let’s see what the new card looks like. Thanks again, Morag for your advice!

MemberFebruary 14, 2023 at 5:13 pm in reply to: All rights Reserved signing and Alternative PassportsThe photo I took didn’t save unfortunately. I’m thinking of returning the card with a copy of their letter, asking them to provide evidence by affidavit that the details listed on the card are the same as I submitted to them on the application form and to reissue with the details I provided. It clearly wasn’t the same photo taken this time so why did they change it? Can I put it back on them to prove that they took their information from my 2023 renewal application? I didn’t write my name in all caps, the address was c/- and my autograph is changed. Yes, I have evidence that I use it regularly at work, by affidavit and on other cards. I’ll be upgrading next month if I pass a practical for an MR so I’m still playing in the sandbox. I can take it up with them then when it’s upgraded. If all else fails, I’ll pay to replace it with correct details and ensure it’s all recorded.

MemberFebruary 14, 2023 at 5:18 pm in reply to: All rights Reserved signing and Alternative PassportsThey didn’t chop off the ARR. They used a completely different signature, from a previous licence before my last one. It was taken from a signature on paper. The last card I signed on a pad and it was messy. I print with the By:Lyn:Mangan., Bene with ARR underneath now. Completely different.

MemberFebruary 10, 2023 at 6:40 pm in reply to: All rights Reserved signing and Alternative PassportsI recently renewed my driver licence. They took a new photo and didn’t comment on my ARR autograph. The new licence arrived with an older photo of me with short hair and old signature. I’ll be doing the 3 step affidavit with them.

I recently renewed my licence and signed with my autograph By:….. ARR. The lady at the counter didn’t ask questions or say a thing. I considered not renewing, but I will require an MR licence for a new machine at work at a council transfer station, so cannot avoid it for now.

It appears they are processing enough of these applications to produce a generic response?

Update: A money Order was sent in October last year for the balance on our partnership account. We last received a fine February 14th for non-lodgement of returns which I also sent last year, but they were in a registered letter they never claimed. I muddied the issue when I mixed my private account with a letter for the partnership. The ATO were sending a statement every week until my response to the fine from Melinda Smith, where I sought evidence the ATO has judicial authority to impose penalties and fines. I haven’t received another notice or statement from them, but I need it to be settled and closed.
Even though I have sent several letters, I am naming this ‘Notice of Default’ with a Notice of Final Default to be sent upon non-response to this. Any comments welcome.
Next I am pursuing all funds/credits returned to my private account by cheque, and by statutory demand for payment if necessary.

Just wondering if anyone here has filled out a company return before? I have severed ties with our accountant, but I’ve never completed a Company return before, or submitted minutes to ASIC. If anyone has any advice, that would be appreciated. I’ve also seen comments that ATO has emailed agents from 13th December, accountants will no longer engage business clients or submit returns without the digital ID. Good excuse to stop playing the game?

I believe ARR does suffice, but I write it in full just to make sure

I responded on another discussion. I eventually got my ARR signature QLD license after a few hiccoughs. Firstly, I signed for my licence on the digital pad and they smiled at the counter and seemed to accept it. However, when it arrived in the mail, they had procured a photo and signature from a Blue Card and used that instead. I called TMR head office and asked for the contact I needed to speak with regarding the breach of contract and possibly fraudulent act that had been perpetrated at the local office as they had not used the details I supplied. They quickly told me the name of the contact and that they would re-issue it at no cost. When I arrived, they took 3 attempts to take photo and signature before the computer accepted it. Apparently it kept ‘crashing’ when it attempted to process the autograph. It was close to closing time and they handed me to a trainee (?) but they were keen to get rid of me, so it eventually went through. Don’t give up. Stay calm and polite and smile nicely. They’re “only doing their jobs”.
-
How were you ‘tried for compensation’? What did that relate to, if you don’t mind me asking? It’s not easy, and the letters are only a fraction of the process. We’re all learning. What works for one may not work for another.
-
In my opinion, it applies to any genuine offer to discharge a debt, including cash, if the recipient refuses it
-
I don’t know if this helps, but for interest’ sake, before I found the source document application, I applied for a BC using my name only and received this BC with name as Lyn, no last name. I blanked out my Mum and Dad’s family names, and other details but the number is the year born/number from my source document, not the standard BC which is a 9 digit number. Not sure if that’s significant, but they used details from source doc and no capital letters. It still has a registration number though 🤔

Thank you! There are so many rabbit holes…

Wow! All there in black and white, now we comprehend what we’re reading
-
It’s all about knowing the exact terminology. now I hear we should get these documents authenticated at state and federal levels to help secure our status.

It was an application for the source document.

I received my source document last year, but forgot to post an update on this thread. It was certified by the Registrar General. I now need to apply for my husband’s and our children’s birth certificates. I see some talk (USA?) of people sending their BC back to get authenticated. Does anyone know of a similar process here? Good luck with the process.

We received a reply on the 17th, with the council letter dated the 7th March. I’m formulating a response now. “Council is empowered under Section 94 of the Local Government Act 2009 to levy rates… and does not require a contract.”?
There are several points to rebut, including the cheque written for the sum certain of $159.85.
-
Will do. Thanks again. I’ve had a few successes so far with a few cases in limbo atm. If the worst comes, we’ll recycle and burn any remaining rubbish.

Hi Morag. I sent a smaller payment with last rates and only received this notice with overdue rates listed. I’m about to send a small cheque for services only from our rates notice, not general rates, but I’m not sure how to word the letter to the CFO. Can you please provide feedback on the draft below?
Within the universal maxim of law ‘notice to agent is notice to principal and notice to
principal is notice to agent’. Time sensitive document, estoppel conditions apply upon default. All addressed parties Jointly and Severally and applicable to all Successors Nominees and/or assigns.

Re: Rate and Water Notice – Property Number: 123456
<b class=””>Location & Description: Nowhere Road, South Nowhere 1234 LOT 1 SP 123
Dear Susan
Circumstances have been trying in recent times, and we appreciate your understanding.
We thank you for your offer to contract in your Rate and Water Notice received 26th February 2023.
Our records indicate that the above account’s previous liability of $159.85 was discharged in full by BPay on 26th October 2022 Ref: 123456-1234.
Please find enclosed a cheque for $159.85 being the sum certain (UCC S4, S8(2) & S14(1)) for the services of waste management, rural fire brigade, rescue and state emergency levies.
Take notice, if this cheque is not returned within 72 hours of the time and date of this letter
it is assumed that the cheque has provided full and final satisfaction of the liability according to the Bills of Exchange Act, and you have assented to the terms of this agreement. If no reply is received, you also agree by tacit acquiescence:
1. That you will not enter any negative remarks to a credit reference agency;
2. You will no longer pursue this matter any further;
3. You agree to pay all fee schedules as attached.
Please Note: We wish to deal with this matter in writing and we do not give your organisation permission to contact us by telephone. Should you do so, we must warn you that the calls could be invoiced as per Fee Schedule listed below.
It has come to our attention that the property is held in Fee Simple in which case we have exclusive rights to use and possession and have no contract with you. If you claim there is a contract where you claim authority over our title, and/or we consent to pay rent/rates/tax to council, we need to see evidence of the signed contract between SBRC and ourselves. If you cannot provide it but you presume or you imply there is a contract, we revoke that immediately. Please provide the original contract, or it will be taken there is none in which case, we will not be paying any further General Rates Category 900.
Kindest regards
By: Lyn……

Hi. I only just saw this thread. I submitted a 1099A online in November for a NAB credit card with a balance of $26,000, but didn’t notify them as I thought the duplicate went to NAB directly. I returned the next 3 statements RTS/No contract, etc and they stopped sending statements and charging extra interest or fees, but the balance remained when I checked online. I sent a registered letter to NAB CEO on the 14th February with a photocopy of my live birth source document. When I checked the online account on Monday morning 20th February, the card was wiped entirely! ‘No Cards’, with a message, ‘Would you like to apply ?’ $26,000 debt wiped, no email, no letter. I’m not sure whether it was the 1099A or the source doc. I should have sent a 1096 Form with it for them to complete apparently, and a 1099OID, but that’s a result. Hopefully the matter is finalised.

Hi Morag,
I have some questions regarding partnership and GST. I’ve sorted the private income tax for myself but still sorting my husband. We have a partnership that hasn’t operated for a few years. I have overdue returns, but lodged them last year with apology and asked for forgiveness.
We apparently have an outstanding ATO debt for our defunct partnership which I paid by A4V last year. Is that mixing public and private? I believe as part of a partnership between a living man and woman that I should be able to discharge the debt. I have submitted my affidavit and they credited my account, but withdrew funds for the ‘Integrated Client’. I’ve sent another letter requiring payment refunded as I never consented to my funds being stolen for linked accounts.
They sent a Penalty for Failure to Lodge statement now, which I am writing a letter thanking them for the offer to contract, but we must have missed the memo to attend the court hearing where the ‘penalty’ was determined. Is there evidence the ATO is a court?
I’ll be sending an invoice with it for withheld income tax and another invoice for unpaid wages and benefits as an unwitting, unpaid tax collector/agent as a payroll officer in our small business over 10 years.
See what happens?
Any advice welcome.
