Thanks, Morag. Yes, the company would be a corporation. My son and I have a partnership which runs the business, but the food licence can only be given to a corporation or incorporated association under the Food Act 2006, which binds all ‘persons’. If, as a man and woman we respond that we are not persons, could we not claim to be exempt? No, I don’t know any business owners who have avoided the issue. I’mjust posing the question. It’s all very confusing, annoying, frustrating… we just want to serve our customers.

I act as Director of a sole trading company, but council claims according to the Food Act 2006 a food license can only be held by a corporation or incorporated association. However, on page 15 Chapter 1, Part 2 Application and purposes of Act, Division 1, Application, 3. Act binds all persons (1) This Act binds all persons.
No man or woman is bound by any statute or act? Is this not a remedy being provided?

Yesterday, I received a certified copy of my source document on embossed paper with real signature, I believe from the Registrar General. Is this the enough? It concerns me that it says it’s a certified copy of a document “under the control” of BDM. Do I thank them and say I want the original now and any associated documents because they’re my property?

Yes, place your TFN on pages 1,3 and 5 I believe for recent forms.
Yes, include your witnessed affidavit. I included a copy of birth certificate and an explanatory cover letter to reiterate I’m a living woman, apologize for the late return and seek forgiveness, thus resetting the terms.
They replied within 3 weeks, and 2 cheques were sent last week. My case is a bit messy as it is tied to a partnership account, and they transferred funds without my knowledge or permission but I’m working on it.

Thanks again, Morag. I haven’t returned their call but I informed them with the Estoppel that we don’t do business over the phone and everything needed to be in writing. I thought this would be a fair place to start making a stand

Thank you. Yes, it’s all part of a game. They should be receiving my letter disputing their charges, along with the adjusted return so I’ve already disputed the debt. I try to avoid phone calls

Update on my own application, today I received full credit for all tax withheld for the last 3 years. Thank you, Mark! Only issue is that there was an amount owing previously, so I will be sending another letter requiring payment to myself and an adjustment for the previous return. Will let you know how that goes. Husband and son are willing to try pending on the result of the next step.

Excellent news! I’m awaiting a response to my application, but was expecting delays with the manual processing. My husband is waiting to see if it works first too. We both received PAYG instalment forms which I autographed and adjusted to $0. We haven’t received those for ages? I also applied for my source document to the birth certificate. That was 2 months ago too.

I also have a question regarding the affidavit of expenses as I am listed as director of a small non-reporting company (soon to be dissolved). Should it be included on the affidavit that I, the living woman merely ACT in the capacity as director of said company, or just be prepared to make a statement of fact if they ask?

I’m preparing to send mine soon and I’d like to know the answer to your question. On one version of an affidavit, there’s a clause which states all future correspondence is to be in writing, no doubt to avoid any trickery on a phone call. A local JP signed mine without hesitation and seemed more interested in having a conversation

Question, is the ATO claiming to be a court? How do they have authority to fine anyone? Does that mean the ATO admits they are not working within the constitution? Would you be willing to take it to court? Would the ATO like this aired in court? Keep us posted.

How are you going with it? It’s hard to know where to start. In hindsight, I possibly should have sent an adjustment for existing debt to clear it first, then submit the last few years.

Yes, put the ABN of any payer that withholds tax from you along with earnings and tax withheld. You should find that information on your payment summary.

Mark’s methods worked, but my account is messy because it is linked to other accounts. 72 hrs is very important with any company, but since our accounts are a work in progress and I have sent several registered letters recently, I wondered should I return them just in case

Thank you. I think I’ll leave it as is and cross that bridge when and if I come to it. The affidavit is a statement of I am. I am not a director, no more than a citizen, taxpayer, resident, or any other creature of statute. It is not who I am, rather what I do. In light of that, I have the accountant’s minutes for the company which I haven’t signed or autographed as yet as it has 2 lines, one for Agent and one for Taxpayer. I’m not a Taxpayer though the director possibly is (?). I thought I may autograph on the agent’s line. We will no longer be using the accountant and will send a letter saying so, but there are minutes to lodge for public company compliance

Everything else has worked perfectly. I can download other files and watch videos, but for some reason this Q&A PDF will not open. I can work around it, but letting you know in case others have the same problem. Sorry this is off topic.
