  • Hi, I have sent Equifax numerous letters with no success, they just keep saying they are taking the credit card holders word for it. Despite the numerous legal letter I have sent asking for validation of claim or the contract that I have signed. I have even cited the Truth in Lending Act as well a the credit consumer act, sending an affidavit. Still no success.

    I am now in the process of the one CC company taking me to court, I guess I will see what transpire with this. Hopefully that answers some of your questions. I will keep you posted as to the results of my court hearings. 😟

    I have been in the process of sending a promissory note for another loan I have, but I am going to hold off now until I can clear up this court action against me.

    Okay, I see what you are saying, I will go back and take a look at these specific lines.

    And if you have a contract that they are taking out a direct deposit you cannot pay it off with a PN without changing the contract?

    Plus do you know of the other case Marc was speaking of in a case called Atkinson?

    Okay, I was not going to make any claims. I have been asking them questions about their validation of claim. They are saying they purchased all the credit cards from the other company. Another question I had is there any information or case law that I can draw from that I do not have a contract with them. The original agreement was with the original company I had the card with.

    I know they say that the company in their “agreements” say they can sell the debt to anyone but I have sent them 3 notices and an affidavit asking them to show me the agreement I have with them with my signature on it. Of course they do not respond and only threaten me, and now served me papers to go to court. I have been doing so much research and my defense does not look good as far as case law goes. I know that you would not find a lot if it was thrown out. But I am trying all strategy’s, right now I am working on my response to the notice of claim. These companies are evil and when you want to use their fraud against them they label you as an OPCA litigant lol May God be with me 🙏

    Hi, I had the CC with a company and the CC company was bought out buy a bank. I did not take the new card or agreement and stopped paying, using the card from the original holder. I told them they bought the debt and I was discharged from the liability.

    I asked them to produce the contract, agreement, or validation of claim. I sent 3 notices and a affidavit and they keep responding saying I owed the money with no proof. So now they are taking me to court.

    Another question I had was for student loans, can you do this process for a student loan or would this be a different process. As they changed the laws a few years back stating that even in a bankruptcy you cannot get rid of a student loan that all student loans people are bound by them. Hopefully you know about any info on this thank you 👍

    Also can you tell me who I put in this line on the Notice of Payment and notice and demand to Verify Claim. There is a line at the bottom of the first paragraph that has this. Mark did not touch on it in the video and I do not want to make any mistakes. I know I am the Joanne Helen Smith 😂I am assuming it is the company or the bank where you got the loan. Please advise, Thank you

    Thank you, I cannot seem to find it online. What is Australia’s online court cases, in Canada we use CanLII to look up previous cases. I just cut and pasted what you put and the only one that came up was from 1951. I appreciate your help. 😀

    WOW, your a rock star. 🎸 Thank you so much for the detailed reply. It is a lot of paper work for sure. I have been involved in two cases my self for two and half years myself, everything has been filed and I am just waiting now. I am getting ready to jump into a promissory note, I have been studying the process for about 6 months now and I really want to make sure I know what I am doing before pulling the pin.

    In Canada they are saying that you are not allowed to have anything in your signature only your name. I see that they are making this a push in all areas even in our health cards. Memo’s are going out to all organizations stopping people from doing this. I think it is because so many are trying to do it.
