Valuable FOI Outcome: No Exemptions from Constitutional Compliance!

I wanted to update you on a recent development regarding my Freedom of Information (FOI) request to the Attorney-General’s Department. On June 20, 2024, I submitted a request to access certain documents, and here is the decision I received:
Request Summary:
Documents Requested:
- A certified copy of the exemption instrument that exempts various government entities from upholding the Commonwealth Of Australia Constitution Act (UK) 1900.
- A list of those exempt entities.
Request Timeline:
- June 20, 2024: Request submitted.
- June 24, 2024: Department acknowledged the request and requested a 30-day extension, which I agreed to.
- August 19, 2024: New decision due date.
Decision Overview:
- Search Conducted: The department conducted comprehensive searches of relevant records but did not find any documents matching my request.
- Result: The decision was to refuse access under Section 24A of the FOI Act, as no relevant documents could be found.
As by the office of the Attorney General admitting there were no documents exempting any Government, Gov Agent or employee from upholding and complying with the Commonwealth of Australia Constitution Act,
all those parties are subject to it and must comply with it.
This is a leveller and a game changer.
