Hi There, Have you issued a Form 11 Notice to Remedy Breach to the landlord for any matters of breach of the rental agreement? Issue multiple forms, one for each breach noting the timeframe for remedy under the RTA. Include the sections of the RTRA Act and the sections of the agreement they have breached. This then becomes evidence in any proceeding. Also I have lodged a RTA dispute process with the RTA for landlord breaches and if I could show the section of the ACt and Regulations the landlord had breached, the RTA would point this out to the landlord and the penalty units of consequence for the breach if it continues to court. I had a landlord constantly asking in writing for more advance payments of rent even while I was up to date with rent and the legislation clearly states this is illegal with criminal code penalties, the RTA dispute officer called the landlord, advised them if they continued they could face jail time and the dispute was resolved, they never asked me to advance extra rent payments.

A small update and a question for the Community.

I have moved forward and completed the Acceptance for Value process on a Credit Card Statement to Pay back in April, they have kept the payment. As of the end of July the three demand notice process has been completed and the credit card company still has not answered any of the notices or returned payment. So now I am sending back their letters with the RTS Paid, for Cause without dishonor wording. and hold my position.

My question is, has anyone else made it to this point and what happens next?

and what module should I be reviewing to be ready for whats next?

    Thank you

    Hi Fellow SE Members,

I have been reviewing the Promissory Note module multiple times and the downloadable documents.

My question relates to the Notice of Payment Letter to the financial institution.

Within the template, it is worded for discharging a mortgage an I am seeking to use it for discharging a credit card.

This is what it currently states in the attached image. In my situation for a credit card or even a personal loan I feel I need to delete this section as it would not be relevant.

The instruction document from the download pack is silent on this matter, thank you for your thoughts.

Thank you to all for your replies. I’m learning lots I just spent the best part of today reading the Income Tax Assessment Act, Currency Act and a few other side diversions as I follow the rabbit hole that is our colour of law legislation.

Wow, ok, there is something im missing here, is there something in the constitution or BOE act that states debt can only be repaid in gold or silver?

And please know i appreciate your energies and paitence in answering my questions, i hope to be where you all are soon and able to help others with their questions. 🙂

I was listening to Marks 3 day Melbourne Workshop and someone in the audience asked a question but due to the quality of the recording the answer was muffled.

The question is the same one I had yesterday while pondering this information.

The question was: We issue a promissory note and set the meeting at a the reasonable timeframe then attend the location. If the drawee (the one we sent the PN to, if I have the terminology right), shows up and requests payment on the PN, should we have the currency ready to pay their request or what should we do ( setting aside the other feedback that, to date, none have ever showed up). For example my personal liability may be $30K and I issue the PN for $35K, I likely wont have $35K sitting around to pay the PN if they show up. What do I do? Thanks

On the top of the court affidavit there is a reference UCPR35, does this apply to all States or should this reference be changed for the Qld court system?

Some amazing testimonies in the above thread, exciting times indeed.

I was reviewing the two affidavit documents in the Tax module download pack and at Item 6 the word ‘Seem’ appears, is this a spelling mistake or a correct legal word? Should it be ‘Seen’?

    Thank you

This is wonderful news, sad you went through it in the first place.

To clarify when you state ” natural law trust” is that the same as private trusts unregistered that Solutions Empowerment teaches folks to use?

Thank you morag-janet i will join the call.

I came across these two failed attempts of using promisory notes in Australia, does Mark address the reasons why they failed in their attempt in any training or other areas of this platform? It would be great to see if the learnings from these cases have been applied to the current version of process?

Thank again to all who have responded and thank Saul-james, this has been a quite beneficial conversation.

I will continue on the learning journey and lodge the PN and keep this area updated on the progress.

If others have personal loan stories i would value hearing how your experience was and outcomes.

And i am sure i will be back with another question 🙂

Hi Saul-James, interesting. So take what we save now by using the promissory note and buy some silver while its low, store it a way in the event they ever come to collect….

I was listening to the Promisory video training and Mark mentions a Gold Stamp he uses on his pNotes. Does anyone know where to buy or get one of these from?

Also I was wondering, could the lender ever consider fraud charge against me for the perception on the timing, could they put forward an allegation that I obtained the loan with the foreknowledge of then paying it out with a PN thereby not having an intention to not pay it from the begining( which is not true) but..?

Hey Chris, thank you for sharing, it is such an encouragement to hear of your win.

I wonder if they would ever call on us to make good the promissory notes we write and issue? I am still learning and my understanding of promissory notes is the drawer (us) will have to make payment if its called up by the drawee in the future? Or have I got it wrong.

Hi Friends, I have just been introduced to the solutions empowerment and a new member, and wow, I thought my eyes were open before but in the last 2 days, but now im in shock at the rort we reside in. SO congrats to everyone who has stepped up to the ato, its so great to hear recent success stories. I am currently lodging an amendment to last year following the principles and information provided.

I did have one question if someone would mind clarifying please, as its not shown in the videos or text that I saw.

On the declaration page of the ato form we are all writing “All remuneration collected by agent for principal”. I understand that me the living man is the acting as the agent for the public ALL Caps name and making direction as the agent however in the context of this statement what is it specifically saying please?

    Thank you

Hi There, I went to the Bundaberg Transport Office and apart from the computer not accepting my new autograph three times (and then the staff member restarted her computer and then it accepted it on the fourth time) it all went smoothly, no challenges.

Hi Brino, I have noted in a couple of Marks Q&A, the ATO permits two previous years amendments can be made. It is also on the ATO website.
